AG Chambers to intervene in Gerakan’s hudud law challenge

PUTRAJAYA: The Attorney-General’s Chambers (AGC) is applying to intervene in Gerakan’s motion to challenge the constitutionality of the Kelantan hudud law which was passed by the state legislative assembly in March.
Gerakan’s counsel Chai Ko Thing said that senior federal counsel M Kogilambigai had confirmed that the AGC would apply to be a party in the motion.
The matter came up for case management before deputy registrar of the Federal Court, Jalidah Hamid who subsequently fixed August 11 for further case management to enable the AGC to submit the required documents to support its application.
Chai also disclosed that lawyer Sulaiman Abdullah would be appearing for the Kelantan state government.
He said former Federal Court judge Gopal Sri Ram together with lawyers Harpal Singh and Chang Ko Youn would be representing Gerakan in the motion.
Gerakan had filed an application seeking for leave of the Federal Court to initiate a petition to challenge the constitutionality of the Kelantan Syariah Criminal Code II 1993 (Amendment 2015).
In the notice of motion filed on May 8, this year by three Gerakan members, namely Tuan Mat Tuan Wil, Soh Hoon Lee and Chung Mon Sie, they said the Kelantan state legislative assembly did not have the power to make laws penalising criminal acts that were punishable under the federal law.
They claimed that the state legislative assembly’s approval for amendments to the Code was invalid and void as it was not in line with the Federal Constitution.
They had named the Kelantan state government as respondent in their notice of motion.
