So What Exactly Is "discredit / ridicule" government?

M'sians who discredit / ridicule Govt in whatever way can be barred from travelling o'seas for three years.

Those who disparage Govt while abroad also barred travelling abroad again for three years upon their return.

Immigration enforced this ruling several months ago 

Anyone who runs down Govt or ‘memburukkan kerajaan’ in any manner barred 

“Only Immigration DG authorised to look into appeals

dept would act upon request from enforcement agencies such as police

Immigration DG Sakib Kusmi confirmed existence of such provision

adding that ownership of a M'sian passport a privilege and not a right

Govt has discretion to either issue, defer or revoke the travel document

Sakib could not provide statistics on number who have been barred from leaving country for discrediting or ridiculing Govt.

bankrupt, legal cases, yet to pay govt loans regularly stopped from leaving 

M'sians who are barred from travelling abroad could challenge this in court Sakib said
  • convicted for committing a crime at home or abroad
  • deliberately damaging passports 
  • visiting Israel without approval 
  • among offences listed 
  • can be barred from travelling abroad for two and 10 years.
Malaysians caught and deported for overstaying
committing crime 
working without a valid permit abroad 
will also be barred for two years.

My comments :  I have a question for the DG Sakib Asmuni. What exactly is 'ridicule / discredit' the gomen?  Apa definisi  'memburukkan kerajaan'?

Is there a bill or Act of Parliament which clearly defines what is the meaning of "memburukkan kerajaan"?

Also if someone "memburukkan kerajaan negeri Pulau Pinang (pimpinan DAP)" or "memburukkan kerajaan negeri Kelantan (pimpinan PAS)" then will they also be barred from leaving the country? Or does this apply to 'memburukkan kerajaan BN sahaja'?

Or does this apply to 'kerajaan Persekutuan sahaja' and does not include kerajaan negeri?

Since it is the DG of Immigration who will be responsible for barring Malaysians from travelling overseas and the people have recourse to the Courts then please be aware that the DG of Immigration can be held liable for your actions.

The DG of Immigration may also be sued personally for libel and damages in the Civil Court  (for example for negligence).  Dont think it is not impossible. 

A passport is neither a right nor a privilege. It is just a piece of stationery.  Like an IC. 

Can Asmuni answer this question : Is an Identity Card a right or a privilege?  It is neither a right nor a privilege. It is just a piece of stationery issued by the gomen.

Same with the passport. Once a citizen pays the passport application fees and the gomen accepts the money over the counter, the gomen is obliged to issue the passport. The citizen PAYS for his own passport. 

The Court can bar someone who is facing criminal charges from leaving the country. The Court will ask the barred person to hand over his passport to the Court. This is a transparent process, preceded by arrest and appearing in Court.

But in this case (ridiculing / discrediting gomen) a person may not know he has been barred from travelling overseas until he or she goes to the airport to board a flight. This is very unjust.   Quite uncivilised.   

Legally, a Malaysian citizen can get back  into the country just by showing his IC. Malaysians citizens do not need a passport to come back into Malaysia.You are already a citizen of your own country.

  
We actually need a passport because other countries require a passport from us if we wish to enter their countries. A passport is just a travel document.


Here is another question for Asmuni : how many other civilised nations in the world prevent their people from travelling overseas for 'membuukkan kerajaan'?  

The DG of Immigration, the Police etc should remain professional and perform their duties professionally. Do not get influenced by the politicians.
