Syariah court fines Khalid RM2,900, parliamentary seat at risk



Parti Amanah Negara (Amanah) communications director Khalid Samad is facing the risk of losing his Shah Alam seat in Parliament and being disqualified from contesting in the next general election.
This is after the Klang Syariah Court fined him RM2,900 for teaching Islam without having proper credentials.
Khalid, who was found guilty of the offence last month and sentenced this morning, faces three months' jail if he fails to settle the fine.
Article 48(1)(e) of the Federal Constitution states that a Member of Parliament will be disqualified should he or she be imprisoned more than a year or fined more than RM2,000.
Khalid will also be barred from contesting in elections for five years after the sentence is completed.
However, he can retain his seat pending an appeal.
"We will pay the RM2,900 fine first, then we will file an appeal on the decision," Khalid said when met by reporters at the Klang Syariah court.
Vague definition
With the general election expected to be held soon, the possibility of the Amanah leader contesting is now compromised, as he could lose his seat should his appeal fail.
Khalid had committed the offence of "teaching Islam" without credentials at the Taman Semanta surau in Klang on Aug 16, 2011.
He was charged under Section 119 (1) of the Selangor Islamic Law Administration Enactment.
He maintained that he did nothing wrong, and was only sharing his experiences of having gone to Gaza.

"For me it is a compulsory responsibility for me to share my experience as that was what (former) Gaza president Ismail Haniyeh told me to do," Khalid said.
He added that the definition of "teaching Islam" needs to be refined so as to be more clear.
In a related development, Election Commission chief Mohd Hashim Abdullah said he would check with appropriate authorities regarding the status of Khalid's seat.- Mkini
