On CEC polls, Zahid has good news and bad news for DAP



Deputy Prime Minister Ahmad Zahid Hamidi today said he has good news and bad news for DAP concerning its registration status.
The good news, said Zahid, is that that the Registrar of Societies (ROS) will not deregister the party.
The bad news is if DAP doesn't hold its central executive committee (CEC) re-elections as instructed, they may not be able to contest the next general election.
Zahid said this is because the signatures of an approved party executive on their nomination papers for the election would not be valid.
"If they're waiting for their party to be declared illegal or deregistered, the ROS won't do that.
"But if they disregard the ROS' directive... If their CEC is not recognised (by ROS), then the appointment letter issued can't be validated, thus their candidates can't contest," Zahid said at a press conference in Kuala Lumpur today.
Go to court again
The ROS on Friday ordered the DAP to hold fresh CEC elections, claiming its 2013 re-election was not in accordance with the law.
DAP has slammed ROS for taking four years to announce this, particularly after apparently settling the matter during DAP's judicial review application in 2014.
At the time, DAP national legal bureau chief Gobind Deo Singh produced a transcript of ROS' declaration made in court that had read: " ...the ROS recognises that the DAP CEC elected on Sept 29, 2013 may carry out all its powers, functions and duties in the administration of the daily affairs of the DAP in accordance with the constitution of the DAP".
Following ROS' admission, DAP had withdrawn their application.
Zahid said the DAP may present this argument again in court if they find it necessary.
Expect ROS letter next week
When asked about the delayed response from the ROS, the deputy premier replied that the ROS gave DAP plenty of time to comply with the re-election directive.
He added that the written directive to DAP will be issued next week.
The DAP had in 2013 voluntarily held a CEC re-election after an excel spreadsheet error affected the results of the election held on Dec 15, 2012.

The result of the re-election was communicated to the ROS on Nov 8, 2013, pursuant to the provision of our constitution and the Societies Act 1966.
The ROS, however, did not recognise the 2013 election outcome either and DAP took them to court.
