Muhyiddin shouldn’t interfere in Siti Kasim’s case, says lawyer

PETALING JAYA: A lawyer has disagreed with calls for Home Minister Muhyiddin Yassin to intervene in the case of activist and lawyer Siti Kasim who was arrested following allegations that she had kidnapped her client and also prevented police officers from carrying out their duties.
Saying it ran contradictory to the new government’s vow to uphold the “rule of law”, Malaysia Muslim Lawyer’s Association president Zainul Rijal Abu Bakar told FMT that such calls would give a signal that the due process of law could be ignored.
“This is uncalled for. Everybody, including the executive, must let the due process of law take place.”
Zainul said the facts of the case had to be investigated and made clear first.
“If there is an abuse of police power Siti should bring it to court for determination. I am sure a lawyer like her also does not wish the executive to interfere in any investigation process whether it is for or against her.”
“Siti has many avenues for legal recourse, but it shouldn’t include asking the home minister to interfere.”
Zainul said that if the home minister was allowed to determine the action of the police, then Malaysia is no better off than before.
“If the police have taken actions not in accordance with the law, the court is the best place to seek remedy.”
Meanwhile, another lawyer Shaharudin Ali had a different view and questioned the silence of the Cabinet.
“It appears there was a blatant disregard of the rule of law and criminal procedure. Those who participated in the raid of Siti’s home must be brought to bear the full force of the law.
Siti, according to Shaharudin should initiate proceedings against those responsible.
Earlier today, Siti expressed hope the home minister would look into the police’s actions which she described as “high-handed”, after cops raided her home on Saturday night.
This after a report was lodged against her for allegedly kidnapping her client, a charge, which she denies.
Siti was arrested at the Kajang police headquarters on Saturday and released yesterday following the court’s dismissal of an application for her remand. - FMT
