Bersatu's case against ROS settled


A judicial review proceeding on the temporary dissolution of Bersatu by the Registrar of Societies (RoS), which was fixed for today, did not go on after both parties agreed to settle the case.
Bersatu secretary-general Shahruddin Md Salleh had obtained leave to initiate the judicial review proceeding against RoS and the High Court had fixed today to hear the matter.
This was told to the media by lawyer Rosli Dahlan, representing Bersatu, after today’s proceeding in chambers before judge Azizah Nawawi, which was also attended by senior federal counsel Shamsul Bolhassan, representing former RoS director-general Surayati Ibrahim, who was named the sole respondent.
Rosli said both parties had agreed to settle the case based on several terms, including that it had complied with a notice issued by the respondent under Section 14(2) of the Societies Act 1966 and submitted the relevant documents as requested through three letters dated March 27, 29 and 30 this year.
He said the respondent also verified that Bersatu was a registered political party which was established on Sept 8, 2016, and had never violated RoS regulations, as well as always carried out activities that were in compliance with the constitution and the Societies Act 1966.
“The respondent also confirmed having revoked the interim order on the temporary dissolution of the party, dated April 5, through a notice dated last May 16,” he said, adding that the settlements were recorded by Azizah with no order to cost.
Last April 23, the court allowed an application by Bersatu to initiate judicial review proceedings against RoS after dismissing a preliminary objection by the Attorney-General’s Chambers.
