Lieutenant-Colonel Abdul Aziz Buyong and his wife Lieutenant-Colonel Norhayati Hassan today withdrew their RM2 million suit against blogger Raja Petra Kamaruddin.
The withdrawal was recorded by Kuala Lumpur High Court judge Su Geok Yiam.
Raja Petra's lawyer J Chandra, when contacted, confirmed the withdrawal of the suit, citing that the terms, which were undisclosed, have been recorded.
He said this is after the couple withdrew their appeal at the Court of Appeal after the court allowed Raja Petra to amend his statement of defence.
The couple filed the suit in 2008 over the blogger's claims of their involvement in the murder of Altantuya Shaariibuu.
Raja Petra, in his statutory declaration in 2008, had implicated the two in the murder claiming that they were at the scene of the crime.
The couple sought RM1 million in damages each, exemplary damages and other costs. They also sought an injunction to restrain Raja Petra from repeating the alleged defamatory remarks.
Raja Petra, had in a statutory declaration on June 18, 2008, affirmed that he implicated the couple as well as Prime Minister Najib Abdul Razak's wife Rosmah Mansor in the death of Altantuya.
According to the statutory declaration, Aziz had placed C4 explosives on various parts of Altantuya's body while being witnessed by Rosmah and Norhayati.
Raja Petra in his statement of defence claimed they were statement of facts.
"Rosmah, Abdul Aziz and Norhayati were present during this time. My informer informed me that Abdul Aziz was the person who placed the explosives on various parts of Altantuya's body while being watched by the two.
"All three were never implicated in Altantuya's murder or called as witnesses in the murder trial," the popular blogger claimed in his statement of defence.
