PAS Kelantan VS Petronas: A Slap On Anwar’s Face

By: Susan Lim

Eventually PAS admits that there is really nothing wrong with the country’s justice system. PAS knows very well that they can always count on Malaysia’s judiciary in fighting for what they believe is their right.

Unless PAS isn’t sure of the credibility of our judges and attorneys and that the government will never interfere in the process of justice, PAS would never have chosen the law to resolve the dispute over oil royalty demand by the state of Kelantan.

Kelantan has been demanding the federal government to pay the five per cent royalty for oil extracted off its shore as stipulated in the Petroleum Development Act 1974.

Under agreements signed in the mid-1970s, all state governments were promised cash payment or royalty of five per cent for petroleum extracted onshore or offshore in return for surrendering their control of petroleum resources to the national oil company.

But the law has stated that oil and gas extracted from waters that are beyond the three-nautical mile from the shore, prescribed as territorial waters under Malaysia’s Emergency Ordinance (Essential Powers) No. 7, 1969.

Therefore, Kelantan is not entitled to the payment.

The federal government however, is kind enough to give some sort of token to the people of the east coast states, by announcing a goodwill payment (wang ehsan) through its agencies in the states.

Kelantan disagree with the arrangement as they would prefer the cash to be given directly to them - meaning to Kelantan’s PAS leaders. The fact that the money is able to reach the people of Kelantan either way, does not matter to these PAS leaders.

By leaving the matter to the court to decide, PAS is actually stating their trust in the system. If this is the case, then
PAS must have also extended the same trust in Anwar’s case and all other cases.

Whatever the outcome from Anwar’s trial later on must be accepted by PAS members without any doubt and cry of foul towards our justice system.

Or else, all these lawsuit things against Petronas is just a waste of time should PAS really consider our justice system as unfair, unjust, biased, kangaroo court and all.

Perhaps, PAS really has no trust whatsoever in our justice system but is taking Petronas to court anyway just for the drama of it – another prolong court drama that surely involves a lot of money which is rightfully belongs to the rakyat.

It left us with a big question mark for the Pakatan Rakyat, do they or do they not believe in Malaysia’s justice system?
Surely the answer would be, it depends on whether they win or lose. What a crap!
