The Home Ministry and the prosecutor are appealing the ruling of the High Court in Kuala Lumpur that the charge against former Batu Kawan Umno division vice-chief Khairuddin Abu Hassan and his lawyer Matthias Chang do not fall under the Security Offences (Special Measures) 2012 Act (Sosma).
This was confirmed with Malaysiakini today by deputy solicitor-general I Tun Abdul Majid Tun Hamzah.
“Yes, we will be appealing,” Tun Abdul Majid said in a short text message.
A notice of appeal for the ruling will have to be filed within 14 days of the decision.
He also confirmed that the notice of appeal on the matter had been filed at the KL High Court.
Passports surrendered to court
On Nov 18, Justice Mohd Azman Husin ruled that charge against the two, of allegedly sabotaging the financial system of the country by lodging reports in five countries - Switzerland, United States, United Kingdom, Hong Kong and Singapore - does not fall under Sosma.
The judge held that financial services do not come within the ambit of Article 149 (1) of the Federal Constitution.
Following that, Khairuddin and Chang were allowed bail of RM10,000 each and their passports were surrendered to court.
Justice Azman also fixed Jan 12 for case management before him for the matter to be brought before the Sessions Court.
However, with the appeal by the Home Ministry and the public prosecutor, this matter will first have to be heard by the Court of Appeal. -Mkini
