The RM2.6 billion suit by former premier Dr Mahathir Mohamad and two others against Najib Abdul Razak has finally been served on the prime minister's lawyers today.
The case management before deputy registrar Erry Shariman Nor Aripin is fixed on April 20.
Mahathir's lawyer Mohd Haniff Khatri Abdulla confirmed with Malaysiakini that copies of the writ of summons, statement of claim and notice to attend case management were received by the law firm of Hafarizam Wan & Aisha Mubarak.
“It was served by my firm at 10.30am today,” he said.
Two days ago, lawyer Mohd Hafarizam Harun confirmed to reporters that he was instructed to represent Najib on the matter.
Mahathir along with former Batu Kawan Umno division vice-chief Khairuddin Abu Hassan and former Langkawi Umno member Anina Saadudin had filed the suit against Najib last week for breach of fiduciary duty and misfeasance in public office.
The three plaintiffs said due to Najib's position as the “numero uno” of Malaysia, he controls, commands and instructs or insists omissions within the powers of each and every government machinery.
This includes ministries, ministers, parliamentary office (including Public Accounts Committee) and legal enforcement agencies such as the Attorney-General’s Chambers, the police, the Malaysian Anti-Corruption Commission (MACC) and the Malaysian Communications and Multimedia Commission (MCMC).
They further claimed that Najib acted in bad faith to undermine, or cause to compromise various respective institutions involved in the probe of 1MDB scandals related to the remittance of RM2.6 billion and RM42 million or any other amount into the PM's personal bank accounts.
Mahathir also told reporters on March 26 that he hoped the suit will be heard in court, for if it is thrown out, then it is confirmed that rule of law no longer exists under the present administration.
"As per the legal process, suits like this must be brought to the courts to be heard so that it can rule on the matter. If it doesn't make it to court, it means that rule of law is not longer present; there is no rule of law under Najib," the former PM who led the country for 22 years had said. -Mkini
