Four months shaved off Khir's sentence due to 'satisfactory rehab'


The Home Ministry today explained that four months was shaved off Dr Mohamed Khir Toyo's one-year jail sentence after the Malaysian Prisons Department was satisfied by the former Selangor menteri besar's rehabilitation process in prison.
It said this following the release of Khir from Kajang prison yesterday after serving six months behind bars and will be required to serve two more months outside prison under parole.
"Under the country's prison system, a prisoner qualifies for a third of his total prison sentence to be remitted if the Malaysian Prisons Department is satisfied with the level of the prisoner's rehabilitation while serving his sentence in prison.
"In this context, Khir was sentenced to 12 months in prison by the Shah Alam High Court under Section 165 of the Penal Code and commenced sentence on Sept 29, 2015 which should end on Sept 28, 2016.
"His sentence was remitted by four months by the Prisons department and will carry out eight months of his sentence until May 29, 2016," it said in a statement today.
Five conditions imposed
Having served six months in prison, the Home Ministry said Khir was allowed to serve his remaining two months outside prison under parole with five conditions imposed on him.
The conditions are having to report to the Klang district parole officer, reside at an address determined by parole order, participate in any rehabilitation programme determined by the parole officer, cannot leave the district without the consent of the parole officer and cannot leave the country.
The Home Ministry said the parole system had been in place since 2008 and as of March 14 this year a total of 12,550 prisoners have been allowed parole outside prison.
Khir was yesterday released from prison within hours after the parole board granted his application for parole.
Khir was jailed under Section 165 of the Penal Code which concerns a public servant obtaining any valuable thing, without consideration, from person concerned in any proceeding or business transacted by such public servant. -Mkini
