The Federal Court has fixed Oct 10 to hear a reference to a constitutional question on whether Section 4(1) of the Peaceful Assembly Act 2012 relating to the ban on street protests, is legal or otherwise.
The court fixed the date to hear student activist Adam Adli Abdul Halim and Jingga 13 activist Mohd Fariz Musa's referral questions to the Federal Court.
Adam Adli and Fariz were charged with participating in the Kita Lawan street protest in February last year. For this reason, they are challenging the constitutionality of Section 4 of PAA which bars street protests.
On Sept 8, 2015, Adam Adli, 26, and Fariz, 45, pleaded not guilty to a charge of participating in a street demonstration that started from the Sogo Complex on Jalan Tuanku Abdul Rahman to KLCC esplanade between 4pm and 7.30pm on Feb 28 last year.
They submitted the application six months ago to challenge several constitutional issues, including whether Sections 4(1)(c), 4(2)(c) and 4(3) of the PAA were a breach of the Federal Constitution.

Lawyer and Padang Serai MP N Surendran told Malaysiakini that the date has been fixed to hear the application.
“We were informed by the Federal Court's deputy registrar via a letter dated Aug 22 of the hearing date,” Surendran said.
Earlier this month, Kuala Lumpur High Court judicial commissioner Nordin Hassanallowed leave to refer the questions to the Federal Court. -Mkini
