Court allows LTAT's affidavit after dismissing Rafizi's objection



The High Court in Kuala Lumpur today allowed an affidavit in reply filed by Lembaga Tabung Angkatan Tentera (LTAT) pertaining to its defamation suit against PKR Pandan MP Rafizi Ramli.
This comes after Judicial Commissioner Roslan A Bakar dismissed a preliminary objection raised by Rafizi's lawyer Saiful Izham Ramli that it was filed out of time.
When contacted by Malaysiakini, the lawyer said the court recognised that there was confusion in its directive made during a case management held on Aug 12 last year.
Following this, Roslan in his chambers further directed parties to make submissions on Feb 16 on Rafizi's striking-out application of certain portions of LTAT's statement of claim.
LTAT filed the defamation suit after Rafizi claimed that army pensioners were not paid their retirement compensations on time.
The PKR vice-president had alleged that the late payments by 1MDB to Perbadanan Perwira Harta Malaysia for the air base relocation work resulted in LTAT to pump its own funds to enable its subsidiary to pay its contractors on schedule, and having to delay payments to army veterans.
Rafizi claimed that he received complaints from Armed Forces veterans who had been waiting for their gratuity for months.
LTAT refuted the allegations and later filed the suit.- Mkini
