KUALA LUMPUR: The case against returning officer Anwar Mohd Zaid and the Election commission filed by PKR vice president Tian Chua will be heard in the High Court on May 3.
Tian Chua has filed an originating summons against the returning officer Anwar Mohd Zaid and the Election Commission (EC) for not allowing him to defend his parliamentary seat in Batu on nomination day last Saturday.
Tian Chua was disqualified from defending his Batu parliamentary seat on grounds of his RM2,000 fine set by the Shah Alam High Court on March 2 this year for insulting a police officer.
His lawyer, Ngeow Cheo Ying, told reporters at the Duta court lobby that they were seeking a court declaration that Tian Chua was an eligible candidate for the Batu parliamentary seat for GE14 and should be allowed to defend his seat.
“It is a settled law that a fine of RM2,000 will not effect his rights or status as a candidate. And in the previous election, GE13, he was allowed to contest although there was a fine against him for RM2,000. He won and has been carrying out his duties as a member of parliament,” Ngeow told reporters.
Ngeow said they filed the summon at 9.45am today.
Together with the declaration of allowing Tian Chua to contest, they are also seeking cost and consequential reliefs that the court would determine to be fair and just.
EC chairman Tan Sri Mohd Hashim had said Tian Chua could submit a petition to court and they would abide by any decision made by the court.
The Kuala Lumpur High Court in 2010 had ruled that the RM2,000 fine to disqualify a member of parliament in Section 48(1)(e) of the Federal Constitution shall be RM2,001 and above.
