The following "part of a letter"  is going viral. It is dated February 3, 2016. There is no signature in this letter but the story is that this letter was written (in committee) by the recently expired Senator John McCain - addressed to President Obama. The subject is the 1MDB affair.

I am quite disappointed with Dato Azam Baki's statement that the MACC cannot investigate dead people.

There must be a provision somewhere in the Law to investigate corrupt practises, criminal breach of trust, abuse of power etc even when a person involved has died. Particularly so when the public interest is involved or taxpayers funds are involved.

There are two things here - the crime or wrong doing plus the criminals or wrongdoers. Just because the wrongdoer has died or has been sucked into outer space, it does not mean that the crime they committed is automatically wiped out. 

Justice still has to be served.

Plus these crimes were committed with the connivance of other players - many of whom are still alive. The others can and should be investigated.

This is also why I suggested earlier that a special Anti Kleptocracy Commission be set up which will have an array of laws at its disposal (other than just the Anti Corruption Acts which limit the powers of the MACC) to go after all the wrongdoing. If the wrongs cannot be righted under the anti corruption or AMLA laws, then resort to the NSC Act, SOSMA etc. 

This is not impossible. Dont forget Khairuddin Abu Hassan was charged for 'economic sabotage' under the SOSMA just for lodging police reports over the 1MDB.  

Even if we cannot personally get the wrongdoers, the wrongs which they have done - taking assets, wealth and money that is not theirs - should be righted.  The moneys and due rights must be restored.

Imagine after robbing his neighbour and handing over his ill gotten gains to his own wife and children the robber then drops dead. And the authorities say the case cannot be investigated because the robber is dead !!

The law still has a duty to restore the rights of the neighbour who was robbed. 

There has been massive stealing going on in this country for the past decades. The Americans have labelled us a KLEPTOCRACY.  This is a unique situation in the history of Malaysia.  

Obviously the MACC alone is not sufficiently equipped with adequate manpower and enough legal frameworks to deal with this unique situation. We really need to look at an Anti Kleptocracy Commission. With wideranging powers to not just punish wrongdoers but more importantly to restore the wrongs that they committed for so many years - mainly restoring moneys that were ill gotten.
