KAJANG: A food delivery rider and a customer, who was angry that his food was not delivered to his doorstep, were each fined RM800 by the Magistrate's court here for brawling in public.
A video of the fight between Jasmady Jasman, 27, and his customer Saiful Shazni Hanif, 33, in front of a security guard post of a condominium went viral recently on social media.
According to the facts of the case, during the incident which occurred at 11.15am on Nov 25, Jasmady wanted to deliver food to Saiful's doorstep at the condominium in Bandar Mahkota Cheras.
However, the security guard did not allow the rider to go upstairs to the customer's unit.
The delivery rider then rang Saiful, who works as a bodyguard, to come downstairs to collect the food instead.
Displeased with Jasmady, Saiful upon coming down hurled offensive words towards the delivery rider and shoved him to the ground, which then led to a fight.
Both men were subsequently charged with affray. The offence under Section 159 of the Penal Code carries a maximum six months jail term or a fine of up to RM1, 000 or both, upon conviction.
In pleading for leniency, Jasmady said he had acted in self-defence during the incident. He sustained injuries and his motorcycle was also damaged.
Saiful also pleaded for leniency, saying that he was his family's sole breadwinner.
Deputy public prosecutor Muhammad Hairuliqram Hairuddin urged for a deterrent sentence to be imposed on both men as a lesson.
Magistrate Syahrul Sazly Md Sain imposed a fine of RM800 each on both men after they pleaded guilty to the offence.
The court also ordered the duo to serve a week's jail if they fail to pay the fine. - NST
