Zahid says had ‘more than enough’ own money for credit card, blames 'negligent' secretary for using Yayasan Akalbudi funds to pay bills

KL May 25 — Zahid told High Court had “more than enough” in his personal bank account to pay for his credit cards bills
suggesting his former secretary Major Mazlina Mazlan used Yayasan Akalbudi’s cheques to make the credit card payments out of carelessness or negligence.
accused of criminal breach of trust RM31m Yayasan funds, including RM1.3m for his and his wife’s credit card bills.
Zahid confirmed sufficient funds in his own bank account to pay for his personal credit card bills.
on those dates did you have enough money from your personal account to pay those credit cards?
Zahid: Yes the balance every month is more than enough to pay my personal credit cards. More than enough.
If that is the situation, why did Mazlina use Yayasan Akalbudi cheques
Zahid: maybe her negligence by not using cheques from my personal account
she admitted to being negligent, did not know and various reasons
- Earlier read out balance of his Maybank account from 2014 - 2016
- compared to amount in Yayasan Akalbudi cheques during same period
- number of cheques issued were 45, including one unsigned cheque
For all cheques confirmed enough funds in his (personal) account
- Jan 7, 2014 two Yayasan cheques for RM20,000 and RM19,000
- Jan 2014 had RM192,000 in his (personal) bank account
- end June 2014 over RM360,000 balance in bank account
- credit card payment RM100,000 made using Yayasan Akalbudi funds
his bank account balance outstrip payments for credit card bills.
- Dec 2014 RM460,000 bank balance
- credit card payments RM14,000, RM8,000
- Jan 2016 bank balance over RM596,000
- cheque RM54,000 was issued
- Jan 2015 bank balance RM514,000
- April 2015 more than RM624,000
- Sept 2015 more than RM596,000
- three Yayasan cheques issued for personal vehicles’ insurance policies
- three Yayasan cheques for RM24,000, RM43,000, RM38,000
(OSTB : Wow !! So Zahid had plenty of cash in his personal bank account with Maybank. And as you can see his personal bank account was very active. How do we know this? Look at all those different account balances highlighted in pink above. RM191,000, RM629,000, RM514,000, RM596,000 etc etc.
Certainly a lot of money was flowing into and out of his personal accounts.
To have that much funds flowing out from his personal account Zahid must have also signed cheques from his personal account. (Also possible he made Online funds transfers, but he must show evidence to the Court.) And the same secretary Major Mazlina had to control his cheque books for his personal account as well.
The question is how come Major Mazlina did not make any mistakes preparing the cheques from Zahid's personal account?
Zahid said Mazlina made mistakes 45 times preparing 45 wrong cheques from Yayasan Akalbudi accounts.
Yet Zahid has not told the Court that Mazlina made even one mistake preparing cheques from his personal account which had so much activity.
How come?
So Major Mazlina only made mistakes with the Yayasan Akalbudi cheques? That is interesting.)
(OSTB : There is also something else going on here.
- Zahid never allowed Mazlina to use a stamp of his signature to sign his cheques
- signature stamp only for mass stamping of Hari Raya cards
(OSTB : To my knowledge as an ex-banker the banks will not accept cheques with "signature stamps". Every cheque must be signed personally by a human being.
So how could or would Major Mazlina or Zahid Hamidi use his "signature stamp only for mass stamping of Hari Raya cards" to sign cheques from his personal bank account ?

- Does Maybank accept 'signature stamps' on cheques?
In the old days only the public listed companies were allowed to use 'signature stamps' to sign their dividend cheques (to help them save time because there were thousands of dividend cheques issued).
I believe the Ministry of Finance - Treasury - would also use signature stamps on some government cheques. However both the public listed company dividend cheques and the Treasury cheques were specially printed with security features on them - acceptable by Bank Negara. But now public listed company dividend payments are all made Online. No more cheques.
The other point to note is that at the bottom of every cheque the name of the account holder is clearly printed - whether personal account, company account, Yayasan account etc.
Even if the secretary Major Mazlan repeated the same mistake 45 TIMES (45 Yayasan Akalbudi cheques) why didnt Zahid Hamidi notice the name Yayasan Akal Budi (or any other name - other than his own) printed clearly at the bottom of the cheque? Zahid did not notice it 45 times?
- told court she would only stamp his signature if he was overseas
- used her discretion to place chop of my signature although I was in this country
- multiple Yayasan cheques stamped with his signature when he was in Malaysia
- accused Mazlina of using pre-signed Yayasan cheques for other purposes
- 47 charges: 12 CBT, 27 money laundering, 8 bribery .
(OSTB : To me this is also a bit intriguing. When Zahid was in Malaysia (in the office) the secretary was NOT ALLOWED to use the "signature stamp for mass stamping of Hari Raya cards" to stamp the bank cheques. Meaning she had to get his personal signature. Why? The answer is obvious - this was a security measure.
Zahid told the court "she would only stamp his signature if he was overseas". So when Zahid was travelling overseas, ie when he was NOT in the office, then the secretary was allowed to use the "signature stamp for mass stamping of Hari Raya cards" to stamp the bank cheques !! Somehow this does not make sense. When you are not in the country, you allow your secretary to sign your name for you ??
But again my question is to Maybank:
- Does Maybank accept 'signature stamps' on cheques?
