LABUAN: A secondary school teacher has been acquitted of four charges of cheating in connection with transactions involving three plots of land at Kampung Bukit Kuda.
Fauziah Halim, 45, who last taught English at SMK Tansau, in Penampang, Sabah, was charged under Section 420 of the Penal Code with cheating three individuals of a total of RM137,000.
The offence carries a prison sentence of between one and 10 years, and a fine.
She was discharged and acquitted at the close of the prosecution case, after magistrate Kasyfurrahman Abang Ahmad ruled that the prosecution had failed to establish a prima facie case against her.
Fauziah, had been charged with cheating one Salmah Abdul Rahman of RM5,000 and RM72,000 on April 11, 2016 and June 7, 2017, respectively, in connection with the latter’s intended purchase of a plot of land.
She was also accused of convincing one Nor Aslinda Yaacop to part with RM20,000 on Jan 31, 2018 to purchase another plot of land in the same location.
The fourth charge involved an allegation of cheating one Zainol Anuar Nooru of RM40,000 on Jan 10, 2017 for the purchase of another lot in the same locality.
Fauziah was represented by K Rakhbir Singh while deputy public prosecutor Suriyati Jumain conducted the prosecution.
She had been on RM18,000 bail in two sureties since 2019. - FMT
