Ruling if ex-Labuan MP must enter defence deferred to June 23

KUALA LUMPUR: The sessions court here has rescheduled to June 23 its decision as to whether the prosecution has made out a prima facie case against former Labuan MP Rozman Isli.

The decision will determine whether Rozman will be acquitted or called to enter his defence on a charge of using his position to obtain a contract for Labuan Liberty Port Management Sdn Bhd (LLPM).

Lawyer Rafique Rashid Ali said he was informed of the postponement of the decision via email this afternoon.

“No reason was given for the deferment of the decision,” Rafique told FMT.

On April 6, trial judge Rozina Ayob fixed the decision for 3pm tomorrow after hearing oral submissions and seeking clarifications from both the prosecution and defence.

The prosecution had closed its case on Mar 6 after calling 24 witnesses to testify in the trial which began on Aug 11 last year.

Deputy public prosecutor Ahmad Feisal Azmi, who was assisted by DPP Siti Amirah Ali, led the prosecution team.

Rosman is charged as an official of a public body with using his position to obtain gratification for LLPM, in which his father and younger brother had an interest.

The alleged offence was said to have been committed at a meeting room at the transport ministry in Putrajaya on March 21, 2018.

He was charged under Section 23(1) of the MACC Act 2009 and is liable to be punished under Section 24(1) of the same Act, which carries a maximum sentence of 20 years in prison and a fine of five times the value of the bribe or RM10,000, whichever is higher, if convicted.

Rozman won the Labuan parliamentary seat in the 2013 and 2018 general elections as a candidate under Umno-Barisan Nasional, before joining Warisan in 2018.

He failed to defend the seat in the 15th general election last November. - FMT
