Shafee: UN body's favourable findings can help Najib's second review

Najib Abdul Razak's petition to the United Nations Working Group on Arbitrary Detention (UNWGAD) whose findings, if favourable, can be used in a second Federal Court review of his conviction.

This was said by his lawyer Muhammad Shafee Abdullah during a forum in Kuala Lumpur yesterday, who revealed that the committee was expected to complete its investigations by year's end.

Shafee said that although many would question the efficacy of the United Nations, critics should look to how favourable findings by UNWGAD had helped former Brazilian president Luiz Inacio Lula da Silva.

"The (UNWGAD) said this was the most unfair trial that Lula has ever had. So, they gave a strong opinion that was used by Lula for a second review at the Supreme Federal Court.

"We can emulate what Lula did - filling for a second review at the Federal Court.

“The judges who were at the first review cannot hear the second one," said Shafee, during a forum titled "Townhall for Justice - Keadilan Sebenarnya untuk Siapa", organised by Pertubuhan Rangkaian Kebajikan Erat Nusa Rakyat Malaysia, Nusa Sejagat Malaysia, Malaysian Youth Activist and UmnoSiswa.

Shafee said the crux of the petition to the UNWGAD and the Yang di-Pertuan Agong was that Najib's lawyer Hisyam Teh Poh Teik was not allowed to prepare for the appeal case in the Federal Court last year.

The Federal Court refused Hisyam's request for an adjournment after Najib's eleventh-hour decision to swap his legal team.

Eventually, the Federal Court ruled against Najib's appeal for his conviction concerning the misappropriation of funds meant for state-owned SRC International Sdn Bhd.

The Federal Court upheld a High Court decision to jail Najib for 12 years and to fine him RM210 million for criminal breach of trust, abuse of power and money laundering for illegally receiving RM42 million from SRC International.

His sentence began on Aug 23 last year. He is currently incarcerated at the Kajang Prison. - Mkini
