The hearing for activist Wong Yan Ke's bid to strike out a charge of resisting a police order to cease a live recording during a raid almost four years ago is set to continue on May 7.
Magistrate Shahril Anuar Ahmad Mustapa set the date after Wong's lawyer requested a time extension to read through deputy public prosecutor Asma Zamri's written submission.
His lawyer Shashi Devan made the request as the written submission was only sent to them during the hearing at the Petaling Jaya Magistrate’s Court today.
“We received the written submission around 11.15am and as the trial had already started, we did not have the time to read through the submission.
“We hope the court can grant us time to read and reply to the submission,” he said.
Wong (above), a former Universiti Malaya Association of New Youth (Umany) president, was arrested during a police raid over Umany’s article on the role of the Yang di-Pertuan Agong on Nov 7, 2020.
He had filmed the police raid on his phone and defied instructions for him to stop doing so.
Wong was initially charged under Section 186 of the Penal Code for obstructing a public officer but the charges were later changed to resisting a public servant in the discharge of his duty, which falls under Section 188.
In October last year, he was granted a discharge not amounting to an acquittal (DNAA) after all five prosecution witnesses were unable to attend the Petaling Jaya Magistrate’s Court.
However, on Nov 14 the same year, the Shah Alam High Court overturned the DNAA and sent the case back to the Magistrates’ Court for trial. - Mkini
