Senior cop who killed teen was extraordinarily rash, court told

 Prosecution says Nazri Abdul Razak knew that tailing the late Zaharif Affendi Zamrie at high speed could result in the victim's death.

Senior police officer Nazri Abdul Razak acted very dangerously and exhibited “extraordinary rashness” by chasing Zaharif Affendi Zamrie before crashing into the 17-year-old, killing the student who was on a motorcycle, the High Court here was told.

Deputy public prosecutor Afzainizam Abdul Aziz said Nazri had chased Zaharif at high speed and close range knowing that the act could result in the victim’s death.

He said the accused did not slow down his Perodua Ativa even after passing a speedbump in the school area, but instead continued to follow the victim closely before crashing into him at an intersection.

“The actions of the accused were not only imminently dangerous, they were extraordinarily rash. The accused deliberately chased and tailgated an unknown victim, a stranger, by following him closely after the boy had left the school grounds.

“And when the accused got the opportunity, he hit him from the rear at the intersection, when the victim did not know that someone was actually tailing him so closely,” he said.

Afzainizam said the absence of tyre tread marks on the victim’s body did not prove that the teen was not run over, citing a pathologist’s testimony that thick clothing may have prevented imprinting such marks.

He added that information on the Ativa’s speed and brake application was obtained through a special software by a Perodua technical assistant, who extracted the data without having to remove the hardware from the vehicle.

Justice Bhupindar Singh set Oct 28 to decide whether Nazri, 46, should be called to defend himself on the murder charge.

Afzainizam was assisted by deputy public prosecutors Nasrul Hadi Abdul Ghani and Monisha Pandey, while the accused was represented by lawyers M Athimulan, Mior Faridalathrash Wahid and Aiman Hakim Kamaruzzaman.

Nazri is charged under Section 302 of the Penal Code with killing the teenager near SMK Jati here between 11.55am and 12.32pm on Dec 15, 2023.

The senior cop faces the death penalty or 30 to 40 years in prison and 12 strokes of the cane, if convicted. - FMT
