Khalid Samad's defamation suit against Iksim CEO goes for trial

Malaysia Islamic Strategic Research Institute (Iksim) CEO Mahamad Naser Disa today failed to strike out a defamation suit filed by Shah Alam MP Khalid Samad over the allegation that the lawmaker prevented the tabling of the amendment to the Syariah Courts (Criminal Jurisdiction) Act 1965, otherwise known as Act 355.
This came after judicial commissioner Rohani Ismail of the High Court in Kuala Lumpur ruled that there are triable issues to be heard by the court.
The court has fixed Nov 13 and 14 for the hearing of the suit, said Khalid's lawyer Mohd Faizal Abdullah for Khalid.
Naser was represented by lawyers Arek Zakri and Ahmad Kamal Abu Bakar.
Two months ago it was reported that Khalid had failed to reach a settlement to the suit.
Khalid, who is Amanah communications director, filed the suit last December against Naser following a talk he held at a mosque in Bukit Jelutong.
The talk was given as part of a Selangor Islamic Religious Department (Jais) programme on Sept 28 last year.
Naser was quoted as saying in video footage of the talk: “One of the reasons why Act 355 could not be amended was because the people (voters) in Shah Alam had sent (to Parliament) an MP who objected to Act 355. So what to do?"
Following the remarks, Khalid sent a letter of demand to Naser seeking an apology. The latter failed to do so,
resulting in the suit.
Iksim describes itself on its website as an apolitical body formed with the approval of the Rulers' Council. It is tasked with uplifting Islam as the official religion of the country.  -Mkini
