Kedah speaker gets leave to appeal Kota Seputeh


The Federal Court today granted leave (permission) to Kedah speaker Abd Isa Ismail, to appeal the Court of Appeal decision to reinstate Kota Siputeh representative Abu Hassan Sharif as an assemblyperson.

The decision was made by a five-member panel led by Court of Appeal president Justice Md Raus Sharif.

The other judges were Chief Judge of Malaya Zulkefli Ahmad Makinuddin and Federal Court judges Abdull Hamid Embong, Hasan Lah and Suriyadi Halim Omar.

On Aug 18 last year, the Court of Appeal led by Justice Ramly Ali overturned the Kuala Lumpur High Court's decision declaring the seat vacant.

The other judges were Justices Linton Albert and Aziah Ali.

In November 2009, KL High Court judge Alizatul Khair Osman Khairuddin had declared the seat vacant after finding basis to Abd Isa's request, as Abu Hassan was absent from two state assembly meetings that year.

Article 51 of the Kedah constitution states that if any legislator is absent from the assembly without leave from the speaker for two consecutive meetings, his seat shall become vacant.
