
According to a Bernama report, Malaysian Anti-Corruption Commission (MACC) deputy public prosecutor Farah Ezlin Yusop Khan informed the Court of Appeal in proceedings today that the AGC had decided to reject the representation after consideration.
Azmil Muntapha Abas, 50, was convicted by the Shah Alam sessions court on Oct 19, 2022 of receiving a RM5,000 bribe in connection with a court proceeding, and sentenced to six months’ imprisonment and a fine of RM25,000.
The prosecution is seeking to restore this initial sentence after the Shah Alam High Court on Jan 3 this year reduced it from six months’ imprisonment to one day and the fine from RM25,000 to RM12,000.
The appeal was set to be heard today before a panel led by Justice Hashim Hamzah, alongside Justices Zaini Mazlan and Wan Ahmad Farid Wan Salleh.
However, it was postponed due to Azmil being unwell.
His lawyer, Ishak Yusof, told the court Azmil began feeling dizzy on his way to court and sought treatment for extremely high blood pressure. Ishak subsequently requested a new hearing date.
Ishak told the court that his client had previously submitted a representation to the AGC requesting for the one-day jail term and RM12,000 fine to be upheld.
He also told the court that his client had already served the one-day prison sentence and settled the RM12,000 fine.
The Court of Appeal has scheduled April 25 as the new hearing date. - FMT
