Court orders ex-teacher to pay RM88,000 for 4 slaps that caused injury

PETALING JAYA:
The Kota Bharu High Court has ordered a retired secondary school teacher to pay RM88,069 in damages to a former student he slapped four times in 2019.

Justice Rosli Yusoff made the ruling after allowing a civil suit filed by Adam Maidin, now 21, through his mother, Noor Azleen Mohamad, 47, Sinar Harian reported.

The suit named history teacher Isamuddin Ismail, 63, who was also the school’s senior administrative assistant, as the first defendant.

The judge found that Isamuddin had physically assaulted Adam by slapping him on the face and cheeks with both hands from behind.

He said the court had taken into account medical evidence and several hearing tests showing that Adam had suffered injuries, adding that as an educator, Isamuddin had a duty of care towards his students.

The school’s principal, the education director-general, and the government were also named as defendants. They were represented by senior federal counsel Siti Syakimah Ibrahim.

The court heard that in the 10.30am incident, Adam was sitting at his desk with his classmates when Isamuddin approached him from behind and slapped him four times.

Adam suffered pain on his face and ears, as well as dizziness, reduced hearing, and ringing in his ears.

His mother took him to the Berek 12 health clinic before he was referred to Universiti Sains Malaysia Hospital in Kubang Kerian for examination by an ear specialist.

According to a medical report issued in June 2019, Adam suffered hearing problems in his right ear, including mild to moderate mixed hearing loss, which was diagnosed as a traumatic injury believed to have been caused by the slaps.

He transferred to another school about a month later as he was afraid of facing the teacher again and was said to have taken about two to three years to recover from the trauma. - FMT
