Well?

Justice may be delayed, but it can never be denied. It took centuries to exonerate Galileo Galilee. It took two hundred years to prove that Napoleon Bonaparte was murdered with arsenic poisoning. But even if it takes hundreds of years eventually the truth emerges because the truth can never be hidden.

A. Kugan's assault trial: Cop freed

Court rules no prima facie case against him

PETALING JAYA: Police constable V. Navindran (pic) is a free man.

He was this morning acquitted of two counts of causing grievous hurt to A. Kugan while the latter was in police custody two years ago.

Sessions judge Aslam Zainuddin found 30-year-old Navindran not guilty citing the prosecution had failed to establish a prima facie case against him.

Navindran was acquitted without his defence being called.

The policeman claimed trial on Oct 1, 2009 to the charge, under Section 331 of the Penal Code, of voluntarily causing grievous hurt to detainee Kugan, 23, at a Taipan police station interrogation room in USJ, Subang Jaya at 7am on Jan 16, 2009.

He was accused of committing the offense while trying to extract a confession from the victim, who had been detained in connection with the theft of luxury cars.

Kugan died in the station lock-up on Jan 20, 2009, five days after being detained. Two post-mortem examinations were conducted and the second revealed Kugan had been beaten, burnt and starved prior to his death.

Navindran, represented by counsel Datuk P.M. Nagarajan, escaped a possible maximum jail term of 10 years and a fine.

Navindran had pleaded not guilty to two alternative charges under Section 330 of the Penal Code to causing hurt to Kugan at the same time and place.

A total of 24 witnesses were called to testify in the trial which started on Feb 18 last year.

Deputy public prosecutor Mohd Abazafree Mohd Abbas prosecuted.

Well, did I not tell you?

Did I not tell you that three police officers were involved in Kugan’s death, two Malays and one Indian?

Did I not tell you that to avoid allegations of racism, the two Malays would not be charged but only the Indian would be charged?

Did I not tell you that the Indian would eventually be acquitted or else he would not agree to be solely charged when three of them were involved?

And has this not been proven true?

What else did I tell you?

Did I not tell you on the day that Teoh Beng Hock died that he died while under interrogation?

Did I not tell you that Teoh Beng Hock did not commit suicide and that the ‘suicide note’ they ‘discovered’ one year later was fabricated by the Investigation Officer in the case?

And has this not been proven true?

Yes, what else did I tell you? Let us go back even further.

Did I not tell you back in 1998 that Anwar Ibrahim did not beat himself and that he was beaten by the then IGP?

Did I not tell you that they fabricated evidence and issued a false statement in a bid to cover the evil deed to protect the IGP?

And has this not been proven true?

Did I not tell you back in 2005 that more than RM800 billion of Malaysia’s wealth has ‘disappeared’?

And has this not been proven true?

Did I not tell you back in 2007 that the ex-Director of the CCID, Ramli Yusuff, and his lawyer, Rosli Dahlan, were fixed up on fabricated charges?

And has this not been proven true?

Did I not tell you that only the two police officers would be found guilty of Altantuya’s murder while Razak Baginda would be acquitted?

And has this not been proven true?

Aiyah, there was so much which I have told you and some have already been proven, although some like the Anwar Ibrahim case took more than ten years to be proven true while some are still waiting to be proven true. Nevertheless, although it may take ten years to be proven true, they eventually all get proven true.

Justice may be delayed, but it can never be denied. It took centuries to exonerate Galileo Galilee. It took two hundred years to prove that Napoleon Bonaparte was murdered with arsenic poisoning. But even if it takes hundreds of years eventually the truth emerges because the truth can never be hidden.

And the same will happen with regards to the wrongdoings, misconduct, excesses and transgressions of those who walk in the corridors of power.

Eventually the truth will emerge and we will see the evidence of what they really are.
