PUTRAJAYA: The Court of Appeal has dismissed a company managing director’s appeal to overturn a High Court ruling ordering him to pay RM200,000 in damages to a business tycoon in a defamation suit.
A three-member bench chaired by Justice Supang Lian said there was no merit in the appeal brought by M Natarajen, the managing director of Linsun Engineering Sdn Bhd.
“The High Court’s decision is therefore maintained,” said Supang, who sat with Justices Nazlan Ghazali and Choo Ka Sing.
The bench also ordered Natarajen to pay RM15,000 in costs to AK Nathan, the founder of Eversendai Group of Companies.
Nathan filed the suit against Natarajen for sharing a collage of personal chat messages between them to a WhatsApp chat group comprising more than 200 members.
In the messages, Natarajen alleged and insinuated, among others, that Nathan had bribed Shah Alam court staff to delay certain court proceedings.
Natarajen also allegedly said Nathan had refused to pay his debts owed to contractors.
On June 3, Justice John Lee @ Johan Lee said Nathan had established his case on the balance of probabilities that he was defamed in a dispute related to business dealings and alleged corruption.
The High Court judge had also ordered Natarajen to pay RM60,000 in costs.
Counsel Rueben Mathiavaranam appeared for Nathan while M Manoharan represented Natarajen. - FMT
