Coroner’s finding on fatal shooting of businessman untenable, court told

 

The family of businessman G Mohan is challenging a coroner’s open verdict in the Ipoh High Court following his death after being shot at by police in Sitiawan, Perak, seven years ago.

PETALING JAYA: An open verdict delivered by a coroner in an inquest involving a police shooting in Sitiawan, Perak, seven years ago is untenable, the High Court heard today.

Lawyer S Raam Kumar, appearing for businessman G Mohan’s parents, said coroner Ainul Shahrin Mohammad failed to consider admissions by the deceased’s shooters that they were shooting to kill.

“The police also failed to adhere to the Inspector-General’s Standing Orders by not giving warning shots or shooting at the leg of the deceased,” the lawyer said in his submission before judicial commissioner Moses Susayan.

Raam said no bullet casing from the purported revolver used by the deceased was found. Neither were fingerprints, DNA or gunshot residue found on the gun or the deceased.

“There was no reason given why no roadblock was set up if indeed the police were chasing after the deceased,” said the lawyer, who was assisted by V Selvaratnam.

There was also no suggestion that the tyres of the deceased’s car had been fired at, he added.

Deputy public prosecutor Evangelin Simon submitted that a police party gave chase after the car driven by Mohan.

She said the car skidded, but Mohan got out of the vehicle and fired at the police, forcing the police to shoot at him.

Unhappy with the coroner’s verdict, the family filed a revision application in the High Court last year.

According to the facts of the case, a police team was conducting an operation along the Sitiawan-Air Tawar road at about 3.15am on Oct 8, 2016, when they saw a car driven by an allegedly suspicious-looking man.

A post-mortem report revealed that he died of excessive bleeding from one gunshot wound in the chest and another in one of the legs.

Susayan will deliver his ruling on Jan 10. - FMT
