Batu MP and PKR vice-president Chua Tian Chang remains acquitted of a sedition charge over a statement he had made regarding the Lahad Datu incursion.
This follows the prosecution withdrawing its appeal over his acquittal at the Court of Appeal today.
DPP K Mangai informed the three-member bench led by Tengku Maimum Tuan Mat, of the prosecution's decision to withdraw its appeal.
This led the bench to strike out the appeal. This was supposed to be the final appeal by the prosecution, as this case originated from the Sessions Court.
The other judges were justice Zamani A Rahim and Justice Zabariah Yusof.
Chua, better known as Tian Chua, was represented by lawyer Eric Paulsen.
It was reported that the High Court in Kuala Lumpur four months ago upheld the Sessions Court's decision to acquit Chua of sedition, on the grounds that the prosecution had failed to prove that Chua uttered the allegedly seditious words.
The Batu MP was charged in 2013 at the Sessions Court in Kuala Lumpur with making a statement that the militant intrusion in Lahad Datu was a planned conspiracy by Umno to divert attention and frighten the people.
He was charged under Section 4(1)(b) of the Sedition Act 1948, which carries a fine of RM5,000 or three years' jail or both, for the first offence.
Sessions judge Norsharidah Awang in 2014 did not order Chua to enter his defence as the prosecution had failed to prove a prima facie case. - Mkini
