Jenkins family files suit against police, developer over mother’s death

 

In May, a coroner’s court returned an open verdict over the death of Parit Buntar-born Anna Jenkins, who disappeared in December 2017.

KUALA LUMPUR: The family of Australian citizen Anna Jenkins has filed a lawsuit against the police, a property developer and several individuals over her death in Penang, alleging criminal misconduct.

Parit Buntar-born Anna, who was 65, went missing in Penang while on a short holiday in December 2017. Her remains were found at a construction site near the racecourse at Scotland Road in June 2020.

Following an inquest, a coroner’s court returned an open verdict over her death in May.

Anna’s son, Gregory, filed the lawsuit on behalf of the Jenkins family before the High Court here in June.

In their statement of claim, sighted by FMT, the family alleged that Berjaya Land Development Sdn Bhd and two of its employees “tampered” with her bones, along with other personal belongings, when they discovered the remains at the construction site.

The family claimed that they had acted with criminal intent “to tamper Anna’s remains and belongings by not lodging a police report immediately”.

It also contended that the two investigating officers had failed to conduct a proper probe into Anna’s death.

Her death was only classified as a missing person’s case, and not murder or kidnapping, the family alleged.

“Both investigating officers adopted a lackadaisical and subjective mindset in probing the case. They acted without care and were prejudiced in the investigations,” it said.

The family said the investigating officers remained “stubborn” when they were challenged on the way they probed Anna’s death.

The Jenkins are seeking general, aggravated and exemplary damages from the police and the developer.

They also want an order for the government to set up a task force for re-investigate Anna’s death. - FMT
