SHAH ALAM: The magistrates’ court will sentence a 37-year-old freelance designer on Wednesday, after he pleaded guilty last week to stalking a female photographer on X, the platform formerly known as Twitter.
Magistrate Sasha Diana Sabtu said the court would hear a mitigation plea by Safiq Rosli’s lawyers before determining his punishment.
The sentencing hearing was postponed after deputy public prosecutor Zilfinaz Abbas informed the magistrate that the prisons department was not able to produce Safiq in court today.
Sadiq, the first person charged under Section 507A(1) of the Penal Code, has been in custody since August after he was denied bail. The court also ordered that he be sent to Ulu Kinta Hospital for observation.
The law, which came into force on May 31 this year, makes stalking, whether carried out virtually or otherwise, an offence punishable by imprisonment of up to three years, a fine, or both.
Sadiq changed his plea last week and admitted to stalking Acacia Mardiana Daud by sending her messages on social media.
According to the charge, the offence was committed between 1.40am on July 15 and 5.58pm on July 21, despite knowing that the action would likely cause her distress, fear or alarm.
Sadiq was represented by lawyer Fithril Hakim Ab Jalil while Jason Wee held a watching brief for Acacia. - FMT
