Defence counsel claims Azman Yusoff was given immunity from prosecution in exchange for testifying against former prime minister Muhyiddin Yassin.
MACC principal assistant commissioner Mazery Zaini, 42, rejected the assertion by Muhyiddin’s defence counsel, Hisyam Teh Poh Teik, that Azman was given special treatment or offered immunity in exchange for testifying against Muhyiddin.
Hisyam suggested that Azman, the managing director of KCJ Engineering Sdn Bhd, was spared prosecution for allegedly soliciting and receiving bribes linked to the Jana Wibawa programme in return for giving evidence against Muhyiddin.
He pointed out that MACC had investigated Azman and former Segambut Bersatu deputy chief Adam Radlan Adam Muhammad over corruption allegations linked to businessman Lian Tian Chuan, but only Adam was charged.
Hisyam: Did you not find this strange and puzzling?
Mazery: To me, no.
Hisyam: Do you agree if I say that Azman received special treatment from MACC?
Mazery: I don’t agree.
Hisyam: And I put it to you that Azman received special treatment because of a deal, a handshake between MACC and Azman: come to court, give evidence, and we will give you immunity and protection. Do you agree?
Mazery: I don’t agree.
Mazery had previously testified that Azman was neither remanded nor charged over allegations that he solicited bribes from companies in return for helping them secure Jana Wibawa projects.
He said MACC’s investigation found that Azman had acted on a request by Muhyiddin.
In August 2025, the sessions court acquitted Adam of all 12 corruption and money-laundering charges against him after he paid a RM4.1 million compound fine.
The acquittal came after the prosecution accepted Adam’s representation letter and offered him the option of paying a compound fine under Section 92(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
Under cross-examination by another counsel, Amer Hamzah Arshad, Mazery also did not agree that Azman was willing to fabricate a private discussion with Muhyiddin about Jana Wibawa in July 2020 because he was under financial pressure.
Amer: Following the investigation against Azman, his companies were affected after MACC froze accounts belonging to him and his companies.
Mazery: Agree.
Amer: And for that reason, he was willing to create a narrative that there was a discussion between him and Muhyiddin?
Mazery: I don’t agree.
Muhyiddin, 79, is charged with four counts of abusing his position to solicit RM225.3 million in bribes for the party from Bukhary Equity Sdn Bhd, Nepturis Sdn Bhd, Mamfor Sdn Bhd, Azman, and KCJ Engineering.
He also faces three counts of money laundering involving RM200 million allegedly received from Bukhary Equity and deposited into Bersatu’s accounts at AmBank and CIMB Bank.
He is alleged to have committed the offences between March 1, 2020, and July 8, 2022.
