Bar warns lawyers about using ChatGPT output

PETALING JAYA: The Bar Council has warned lawyers of the pitfalls of using artificial intelligence tools such as ChatGPT, saying lawyers “must still conduct your own research” and not rely on unverified output from the software.

In a circular to lawyers, the Bar urged them to independently verify all ChatGPT output and not rely solely on its responses, which “should not be used without verification from reliable sources under any circumstances”.

Artificial intelligence tools such as ChatGPT should complement and not replace research tools in the legal profession, the Bar said, although the software could produce grammatically accurate first drafts and help free up time for legal staff to focus on more complex legal work.

The Bar said indiscriminate use of ChatGPT could affect the legal, fiduciary and other obligations of lawyers to clients and stakeholders in the legal profession.

Use of ChatGPT could save time by allowing lawyers to obtain immediate responses and a high-level overview of legal concepts and principles. However, lawyers must strike a balance in weighing the key benefits and the fundamental risks involved, the Bar said.

The Bar said ChatGPT lacked the emotional intelligence and empathy that a human being possesses and use of ChatGPT could result in a serious risk to client confidentiality, privacy, and intellectual property if the information is inserted without the removal of confidential information.

Specific users may be legally liable if the content generated by ChatGPT is too similar to a third party’s content, while the data or information produced may be manipulated to enable unethical or criminal activity, the Bar said. - FMT
