Horrific autopsy report on Sat: Zahid, Khalid unfit to hold office, Paul Low a disgrace

Horrific autopsy report on Sat: Zahid, Khalid unfit to hold office, Paul Low a disgrace
The family of the late N Dharmendran, who was beaten to death while in police custody, will reveal the full post-mortem report containing "horrific and shocking" details on Saturday, their lawyers told Malaysia Chronicle on Friday.
"Injuries and torture detailed in post-mortem report is horrific and will shock the nation when revealed tomorrow. That no action has been taken 9 days since Dharmendran's death proves the Inspector General of Police Khalid Bakar and Home Minister Zahid Hamidi are unfit to hold office. Paul Low is a disgrace and laughing stock as a human rights minister," N Surenrdan, the family's lawyer, told Malaysia Chronicle.
Surendran will expose the findings of the autopsy at a press conference to be held in the PKR headquarters at 10.30am on Saturday, June 1.
Remanded over a fight but ended murdered by the police?
The 31-year-old Dharmendran, an employee of sewage treatment utility Indah Water, had been remanded since May 11 for suspected involvement in a fight. He was found dead in police custody on May 21.
Surendran, who is also the MP for Padang Serai, had just days ago dropped a bombshell, revealing that Paul Low had made contact with his clients and invited them to a secret meeting without the presence of their current lawyers.
While Low, a former president of Transparency International Malaysia, was quick to deny this, insisting that it was the family who misconstrued his motives, the newly-appointed minister drew criticism for U-turning on his previous appeal to the government to form an independent panel, IPCMC, to monitor police conduct as a means to prevent custodial deaths.
"This is hypocritical because Datuk Low had himself criticised the failure of the government to implement the IPCMC as there is already an existing mechanism to lodge complaints against the police is both hypocritical and irresponsible," DAP sec-gen Lim Guan Eng said in a statement issued on Friday.
"As the then-President of Transparency International Malaysia, Datuk Low told a press conference after presenting the 2009 Global Corruption Report that the watering down of the proposed IPCMC into a special complaints commission ‘strongly indicates the government’s inability to regulate the gatekeepers’.”
What happened to you, Paul Low?
Indeed, there is deep public disappointment with Paul Low, who is perceived by many to have 'sold out' to Prime Minister Najib Razak's corruption-tainted government.
As for Zahid, whose credibility is already sagging after several highly-priced procurement deals he pushed through as Defense Minister, calls are growing for him to step down for abuse of power and interfering with police work. Just today, a group of students protested outside his office, lambasting him for using the police as tools for his political purposes.
"Even though there is a new Home minister, the Home Ministry continues to be partisan and as long as this continues, the police will not be independent,"  student activists Abdul Muqit Muhammad had told the press.
Newly-appointed IGP Khalid Bakar, who was caught lying over another custodial death case in 2009 involving A Kugan, has not been able to counter the perception that he is just another "subservient catspaw" for Najib and his ruling Umno party. Instead, his recent promotion as the country's top cop has ony added to this view.
All three men have rejected the establishment of the IPCMC, arguing that any complaint against the police could be channelled to the Enforcement Agency Integrity Commission (EAIC), which they claim will investigate the complaints and recommend further action if necessary.
They have also tried to shield the 4 cops accused of beating Dharmendran from murder charges or being suspended from work.
“You have to be fair to both sides. You cannot blame the entire police force when something like this happens,” said Zahid.
Take responsibility
Meanwhile, human rights NGO Suaram has demanded that Khalid and Zahid take responsibility for Dharmendrans's death.
"SUARAM expects nothing short of transparency and independence of the police and the Home Ministry in this matter," it said in a statement.
"For as long as the police are allowed to commit these hideous criminal offences with impunity, the police are not qualified boast and to make public announcements on the level of safety and security on the streets. In fact, the police should start focussing to improve the safety of suspects under police supervision and custody."
It has asked for answers as to:
1. Why were there staples on the deceased’s ears?;
2. Who inflicted the bruises all over the deceased body?;
3. What were the grounds considered by the Magistrate in allowing the police’s application for remand?; and
4. The status of investigation on Dharmendran at the time of the application for remand and subsequently bail.
Suaram has also recommended the following actions to be taken by the authorities:
1. An independent and transparent investigation on the officers in charge of Dharmendran;
2. The police to disclose the Daily Journal kept by the officer in charge of Dharmendran during the initial detention and remand period;
3. An urgent intervention from the Magistrate who had approved the remand application and further heard the bail application; and
4. The Attorney General to initiate proceedings against the officers in charge of Dharmendran.
However, neither the IGP, the Home Minister nor the de-facto Human Rights Minister has responded to any of its suggestions.

King wants people to accept election results

File photo of the King inspecting a guard of honour at the National Day parade last year. He reminded the newly-elected MPs and state assemblymen to serve with honest and sincerity and to give their best to the people regardless of their race and religion.KUALA LUMPUR, June 1 — Yang di-Pertuan Agong, Tuanku Abdul Halim Mu’adzam Shah wants the people of this country to accept the results of the 13th general election (GE13) which they themselves have determined.
The King, who also congratulated the members of Parliament and state assemblymen elected, hoped that all quarters would protect the country’s system of parliamentary democracy which has been in practice since independence.
“If there are differences of opinion, use the channels to resolve them as outlined in the Federal Constitution and the country’s laws,” Tuanku Abdul Halim said in conjunction with the official birthday of the Yang di-Pertuan Agong today in his speech that was carried live by RTM last night.
The King said: “The act of casting doubts on an institution that has been entrusted under the Federal Constitution to conduct the general elections in this country is very dangerous and might only cause a never-ending conflict.
“Don’t we ever weaken and destroy our constitutional monarchy system, parliamentary democracy and federal philosophy which all this while have formed the basic ingredients for Malaysia’s success.”
Tuanku Abdul Halim said any political change in the country must be done in a peaceful manner and through the ballot box guided by the principles of the supremacy of the Constitution and the rule of law.
“Are we willing we see our beloved Malaysia destroyed and crippled due to our own actions? It is so easy to destroy a success but to rebuild it, is very difficult.
“Therefore, do not allow this to happen, let’s leave a united and successful Malaysia to our future generations. As the saying goes, ‘sudah terhantuk baru terngadah, seribu penyesalan sudah tidak berguna’ (realising only after the knock, a thousand regrets are of no use now).”
The King also reminded the parliamentarians and state assemblymen elected to serve with honest and sincerity and to give their best to the people regardless of their race and religion.
Tuanku Abdul Halim also called on the people to together continue with efforts towards achieving the national goal of making Malaysia a developed high-income nation.
The King reminded all quarters that the peace and prosperity they were enjoying now did not come easy, but were the result of careful and meticulous implementation of development programmes by the past leaders.
“This August 31, it will be 56 years since we achieved independence and on September 16, we will be celebrating the 50th anniversary of the formation of Malaysia.
“Although Malaysia is relatively still a young nation, we have managed to put it in an exalted position like what it is today.
“However, no matter how perfect the strategies that have been drawn up by the government and no matter how efficient the implementation, if there is no peace in this country, it would not be possible for all our aspirations to become a reality.”
Tuanku Abdul Halim also reminded all Malaysians regardless of their race and religious faith to be united through the five principles of the Rukun Negara, which is the national ideology, and the Federal Constitution, the highest law of the nation. — Bernama

A constitutional blunder by Najib

The first task that Najib Abdul Razak faced upon being sworn in as prime minister on May 6, 2013 after leading the BN to victory in the 13th general election, was to form the cabinet.

Constitutionally, the prime minister does not have a free hand in his choice of cabinet ministers. Article 43(2)(b) of the federal constitution provides that cabinet members shall be "members of either House of Parliament".

Traditionally, the cabinet is dominated by members elected by the people to serve in the Dewan Rakyat. However, prime ministers often do appoint a few cabinet members from the Senate (Dewan Negara).

malaysia parliament parlimen building 050907 frontIt is important to keep in mind that unless a person is a member of either House of Parliament, he cannot be a cabinet member. This is consistent with the position in other parliamentary democracies.

Further, our deputy ministers and parliamentary secretaries also have to be parliamentarians, as per Articles 43A(1) and 43B(1) of our federal constitution. Only political secretaries are exempt from this strict requirement.

It was therefore shocking to note the statement made by Paul Low on May 24 that he has not yet been sworn in as a senator. Yet he "purportedly" took the oath of office as a cabinet minister before the Yang di-Pertuan Agong on May 16.

Article 43(6) of the constitution reads: "Before a Minister exercises the functions of his office, he shall take and subscribe in the presence of the Yang di-Pertuan Agong the oath of the office and allegiance and the oath of secrecy set out in the Sixth Schedule."

The oath of office and allegiance that Low had to take under the Sixth Schedule of the constitution reads: "I, ......., having been appointed as a member of the Senate, do solemnly swear that I will faithfully discharge my duties as such to the best of my ability, that I will bear true faith and allegiance to Malaysia, and will preserve, protect and defend its constitution."

One other cabinet minister (Abdul Wahid Omar) and three deputy ministers who have not been appointed senators also took their oath of office before His Majesty on May 16.

All these appointments are plainly and clearly unconstitutional.

If they uttered the words stated above in taking their oath of office before the Yang di-Pertuan Agong, they told an untruth because none of these five men had been appointed as a senator prior to becoming a minister or deputy minister.

Appointments cannot be backdated

Under the federal constitution, the sequence is plain and clear: one must first be elected by the people or be appointed to the Senate before one can become a minister; and not the other way.

If these ministers and deputy ministers have been discharging the functions of their office since May 16, they have been acting unconstitutionally.

Their appointments cannot be backdated. Neither can their actions be ratified in future. Rather, they have to be appointed to the Senate first, and thereafter required to take their oath of office again before His Majesty.

NONEThe lip-service the government and its officers paid to the federal constitution, which is the supreme law of the land and which overrides all other laws that are inconsistent with it, is again demonstrated by this blatant disregard of something so elementary and so well-established.

Since Merdeka, hundreds of ministers and deputy ministers have been appointed. One would have thought, therefore, that the relevant authorities would have a detailed checklist on the steps that have to be taken for such appointments to be made lawfully and properly.

Senior career officers in the Attorney-General's Chambers, the Prime Minister's Office, the Cabinet Secretariat and the Senate should have given proper advice to PM Najib, so that this debacle could have been avoided.

Much shame has been brought to our system of government by this monumental blunder. Immediate corrective steps must be taken to regularise the position, and an apology made to Malaysians.

Would anybody step up to accept individual or collective responsibility?

Immigration DG, go study the Passport Act

YOURSAY 'The Sedition Act only applies to those acts against Agong and/or the Malaysia government, not BN.'

M'sians abroad 'tarnishing country's image' blacklisted

your saySophiemore: Firstly, which provision in the Passport Act allows the Immigration director-general (DG) to seize the passport of a Malaysian citizen for attending rallies in overseas?

The said act is only applicable to a non-citizen who misuses his passport by committing any particular offence stated therein.

Isn't a DG supposed to be at least well-versed in both the Immigration Act and the Passport Act? Otherwise, is there another secret act or regulation that he is referring to?

Secondly, on what basis can a DG cancel their passports? So long a permit is granted, none of those rallies is considered illegal in those foreign lands that uphold freedom of speech and assembly.

Thirdly, talking about the seditious acts of these Malaysian students, the Sedition Act only applies to those acts against Agong and/or the Malaysia government, not BN.

Odin: Immigration DG Alias Ahmad, what you really meant is that many Malaysians abroad have revealed to the whole world how badly tarnished or blemished the BN is.

They don't have to tarnish the image of Malaysia; it is already tarnished - by BN. By the way, you would do well to go back and study your laws.

Swipenter: After GE13, PM Najib Razak's administration fans the fires of racism, followed by threats by the new home minister to crack down on peaceful rallies, the arrest of dissidents and opposition politicians, and now prohibiting own citizens from traveling within the country and outside.

Or is this a power struggle between adherents of Mahathirism and a ‘reformist' PM Najib Razak to control Umno. So far the conservatives and right-wing elements in Umno are on the offensive with Najib keeping his ‘elegant' silence.

TehTarik: One of the main culprits who has tarnished the country's image is the Election Commission (EC), by their handling of the just completed fraudulent elections. Why not bar the EC chief and his deputy from leaving the country?

How about the ex-judge and the pro-chancellor of a public university who have tarnished the nation's image by their racist speeches?

How about Perkasa chief Ibrahim Ali who called for the burning of bibles? How about his colleague in Perkasa, Zulkifli Noordin, for his disparaging remarks on Hinduism?

It is sad that senior government figures are allowing political partisanship to affect their judgement. Such statements not only damage their credibility, but paradoxically also tarnish the nation's image.

To all Malaysians overseas, make sure you wear a balaclava next time you protest outside the Malaysian embassy.

This is practised by many citizens of communist and other totalitarian states whenever they organise protests overseas. No photo identification, thus no blacklisting. We are now an unofficial police state. So be forewarned.

Clever Voter: In a thriving democracy, opposing views are not only tolerated but welcomed. Only a weak leadership with low trust and full of guilt will abuse its power to threaten and even inflict violence on its fellow citizens.

This country does not belong only to you.

Anonymous_3f94: Stupidity seems a prerequisite to being head of a department of the civil service now.

Can we have legal commentary on the best way of taking legal action against the DG, who is clearly abusing the powers of office to satisfy his personal political leanings?

Eskay: No one could have tarnished our country's image more than the PM and some of his ministers. Just read the international news. Will their passports be cancelled too?

BN leaders are very much in denial mode to check the root cause of their failure in GE13, and instead are trying to pin the blame on others. If they don't change, they will witness themselves that such attitude will cost them dearly very soon.

Not Confused: As every day goes by, this brainless government continues to threaten, intimidate and harass Malaysians who do not agree with them or who criticise them in any way, shape or form.

The poor deluded clowns in Putrajaya seriously do not understand why they continue to hemorrhage support.

FairGame: Our loyalty and allegiance is to the king and country, not to the government, which is rightfully elected by the rakyat.

On what basis is the rakyat denied or bar from entering or leaving the country solely on the basis of criticising the government for its excessive and strong-arm tactics?

It seems that no efforts are spared in intimidating and harassing the rakyat from speaking out against this regime.

MockingYou: So does this mean Malaysians here in Malaysia, especially Umno-BN goons, can tarnish the country's image and go unpunished? - Malaysiakini

Cara Bersetubuh Dalam Islam

Firman Allah s.w.t bermaksud:

(Surah Al Baqarah ayat 223)

Menurut Ibnu Jarir At Tabari, “ladang” bermaksud tempat menanam benih.

2- PETUA MENCAPAI KENIKMATAN JIMAK

a. Goyangan Kesabaran

b. Goyangan Jongket

- Bahagian tubuh anda keatas sedikit sehingga batang zakar kelihatan bengkok.

e. Goyangan Berpasangan

- Suami mengoyang dahulu kemudian berhenti.

2. Teknik Tahan Nafas

a. Semasa memasukkan zakar, tahan nafas sehingga tenggelam semua zakar. Diamkan sebentar . Kemudian baru lepaskan nafas.

b. Semasa buat goyangan sorong tarik, tahanlah nafas dan apabila hendak lepaskan nafas, hentikan goyangan.Begitulah seterusnya. Petua ini dapat melambatkan keluarnya mani.

3. Teknik Nafas Songsang

a. Semasa goyangan (keluar masuk zakar), hendaklah berlawanan dengan keluar masuk nafas isteri. nafas isteri keluar, zakar masuk dan apabila nafas masuk zakar ditarik keluar.

Bila suami terasa nak inzal, suami hendaklah berenti mengoyang . Jika isteri asyik mengoyang-goyang suruh dia berhenti sekejap.
