Lim said the High Court, in striking out a suit by a member to stop the election, showed that the party has the right to hold polls via a special congress as stated in its constitution.
"I am glad the court upheld justice in its decision today and this shows the Registrar of Societies is ignorant of the law.
Referring to Abdul Rahman, who is the RoS director-general, Lim said, “He is not qualified to be the d-g as he is carrying out a political agenda. He should just resign".
Lim added that today's decision was not for the party alone but for those fighting for democracy.
The DAP secretary-general said he was sure that RoS would try to stop the polls on Sunday and urged all party members to turn up.
On July 30, RoS directed the party to hold fresh election. Although the party abided with its direction to avoid de-registration, the registrar insisted that DAP failed to follow its directive properly to hold the election via a national congress.
DAP decided to hold the election via a special congress which is provided for in the party's constitution.
To hold a special congress, delegates must be given seven days’ notice but for a national congress, a minimum 10 weeks' notice must be given.
Lim's counsel, Karpal Singh said that disgruntled members who had raised the complaints would now have to accept the court's decision.
"As directed by RoS, the election of CEC will go on this Sunday. We are going strictly by the law," he said.
