First conviction under PAA, PKR man fined RM6,000
Johor PKR executive secretary was sent to jail today after he refused to pay a fine of RM6,000 imposed by a sessions court in Johor Bahru that found him guilty of organising a Black 505 Rally last May.
He is believed to be the first person convicted of being an organiser of the Black 505 rally that have been held around the country by the opposition in protest against the results of the 13th general election.
Sessions judge Muhammad Jamil Hussin, found the prosecution had proven its case beyond reasonable doubt and ruled that the non-calling of Johor PKR chief Chua Jui Meng (left), who was named as the organiser of the Johor Bahru rally, did not affect the prosecution's case.
"Hence, the court sentences you to a RM6,000 fine or three months jail," Jamil ruled in imposing the fine.
However, according to lawyer Hassan Abdul Karim for Yuneswaran, the executive secretary decided not to pay the fine in protest against the court decision.
"As a result of this, he will be sent to the Ayer Molek prison overnight. It remains uncertain whether he will pay the fine tomorrow. If he does not pay the fine there is a possibility that he will be transferred to the Kluang prison," Hassan told Malaysiakini.
Yuneswaran was charged with failing to notify the Johor Bahru Selatan OCPD 10 days prior to the date of the rally near the PKR office on Jalan Beladau 19, Taman Puteri Wangsa, Ulu Tiram, at about 8.30pm on May 15.
Yuneswaran was called to make his defence was called on Aug 1, 2013.
Hassan said he has received instructions to appeal the sentence and conviction as this involves a human rights matter as the PAA is an extension of the Police Act and the right to assemble is a guaranteed right under the federal constitution.
"It is a matter for the superior court to decide," he said.
