Two brothers of murdered deputy public prosecutor Anthony Kevin Morais are feuding over his remains, with one claiming the body from the Kuala Lumpur Hospital mortuary yesterday – on the very day the other brother filed an application in court to have a second post-mortem conducted.
Charles Suresh Morais wanted a second post-mortem conducted and his lawyer Americk Sidhu had filed court papers in the High Court yesterday.
However, even before the court could fix a hearing date, another brother, Datuk Richard Morais claimed the remains yesterday morning.
Americk today told The Malaysian Insider that a press conference or a press release would likely be issued tomorrow on the turn of events.
Richard, when contacted, declined to divulge details, including whether the body had been cremated.
Americk had accompanied Charles last week to the Attorney-General's Chambers (AGC) to be briefed on the outcome of the post-mortem conducted by government pathologists, a source told The Malaysian Insider.
“Charles was not happy with the report and had instructed Americk to obtain permission from the court to carry out the second post-mortem,” said the source.
Charles was also said to be prepared to engage a pathologist from overseas.
The Malaysian Insider also understands that the Kuala Lumpur Hospital authorities had pressured the family members to collect Kevin's remains following the conclusion of the post-mortem.
Kevin's body was found in a cement-filled oil drum on September 16 after his abduction on September 4 after a fender-bender along Jalan Dutamas in Kuala Lumpur while on his way to work.
A wake in Kuala Lumpur and two memorial services were held in Shah Alam and Penang without his body.
On September 28, six men were charged with murder, while an army doctor and mechanic were charged with abetment over the killing..
G. Govindan, 47; S. Nimalan, 22; S. Subramaniam, 44; A. Thinesh Kumar, 22; M. Vishwanath, 44; and R. Dinishwaran, 22 allegedly murdered Kevin between 7am and 8pm somewhere along Jalan Dutamas Raya in Sentul and Jalan USJ 1/6D in Subang Jaya on September 4.
Pathologist Dr R. Kunasegaran 52, and mechanic A. Murugan, 44 were charged with abetment.
No plea was taken when they were charged before two separate magistrates in Kuala Lumpur and Petaling Jaya.
Both offences carry the death penalty upon conviction.
Murugan's case will be mentioned on Thursday in Petaling Jaya and the prosecution is scheduled to hand over a copy of the post-mortem report and other related documents to the accused lawyer in preparation of his defence.
For the rest, their cases will be mentioned on November 30 in Kuala Lumpur.
Police had earlier said that Morais was the prosecuting officer in the case in which the military doctor, attached to the pathology lab at Tuanku Mizan Military Hospital, was charged with unlawful trade in December 2013.
In September last year, the doctor, who was on a RM100,000 bail, had claimed trial to two bribery charges involving RM700,000 for allegedly recommending three companies to supply medicine and disposable medical tools to the hospital.
