Court throws out Home Ministry’s stay plea

No reason for High Court to grant Home Ministry’s plea for a stay order on The Edge.

KUALA LUMPUR: The High Court in Kuala Lumpur on Tuesday denied the Home Ministry a stay application on The Edge publications quashing its three-month suspension order, according to senior federal counsel Alice Loke Yee Ching after meeting Justice Asmabi Mohamad in chambers.
“The court denied the stay on the grounds that litigants should not be deprived the fruits of successful litigation as well as there was no reason. There was no harm by continuing publication,” she said.
She added this means The Edge can continue printing their newspapers.
Loke said Justice Asmabi also ordered the cost of RM4,000 to be paid to the business publication. The hearing for assessment of damages has not been fixed pending appeal at the Court of Appeal, she added.
She said in the appeal, the arguments will be on whether the Ministry was correct in issuing the order.
“It will not be academic, even if the appeal hearing would be after the three-month order which was supposed to be expiring on October 27,” she said.
However, no dates have been fixed to hear the appeal.
On September 21, the High Court lifted the three-month suspension against The Edge daily and weekly newspapers.
Subsequently the Ministry filed an appeal.
