A magistrate has rejected an application by the police to remand PSM central committee member Khairul Nizam Abd Ghani.
PSM secretary-general A Sivarajan said the request was rejected by the presiding magistrate at the Dang Wangi district police headquarters after hearing arguments by Khalid's lawyers that remand was not necessary.
"The lawyers said that since Khairul Nizam is being investigated for a Facebook posting, there's no need for remand as police can access the posting at any time," Sivarajan told Malaysiakini.
However, he said it is still not clear which of Khairul Nizam's postings is under probe.
Sivarajan said Khairul Nizam is currently having his statement taken, and is supposed to be released afterwards.
"However, we don't know if he will be re-arrested," he said.
Khairul Nizam was arrested yesterday under the Sedition Act and the Multimedia and Communications Act.
Malaysiakini understands that he is being investigated under the Sedition Act for criticising the arrest of fellow PSM activist Khalid Ismath.
Khalid was arrested at his office in Johor on Oct 7 under Section 233 of the Communications and Multimedia Act over an online posting commenting on anti-1MDB Umno man Khairuddin Abu Hassan and Johor lawyer Kamal Hisham Jaafar.
After the remand expired on Oct 9, Khalid was re-arrested under the Sedition Act. He was finally released on Oct 29.
