KUALA LUMPUR: The High Court in Najib Razak’s corruption and abuse of power trial heard today that an SRC International Sdn Bhd executive who has links with Low Taek Jho, also known as Jho Low, acted as company secretary in taking minutes of board meetings.
Ismee Ismail, the former chairman of SRC International, said Terence Geh performed the function at two meetings in 2012, one of which through conference call.
This means he was not physically present but took notes of the proceedings chaired by Ismee.
During cross-examination by lawyer Harvinderjit Singh, Ismee, the 39th witness in the trial, said he was told that Geh, KC Tang and SRC International CEO and managing director Nik Faisal Nik Faisal Ariff Kamil were known to Jho Low.
Ismee said he did not question why Geh was acting for the company secretary, BNM Consultancy Service Sdn Bhd, appointed by SRC International.
When asked if Geh was an executive of SRC International, he said yes.
When asked if he thought it was odd for Geh to take minutes when SRC International had a company secretary, he said it did not cross his mind at the time.
Harvinderjit, who has been cross-examining Ismee since last Monday, is arguing that the minutes of the SRC International board meetings are not a true reflection of events as they could have been doctored.
The lawyer is also arguing that Nik Faisal misled the board by not providing an accurate directive of SRC International’s ultimate shareholder, 1MDB and the Finance Ministry Incorporated.
Najib faces six charges of money laundering and criminal breach of trust in the transfer of RM42 million to his account from SRC International Sdn Bhd, a former unit of 1MDB.
He is also accused of abusing his power as prime minister by giving government guarantees on SRC International’s RM4 billion loan from Retirement Fund Inc.
The hearing continues before trial judge Mohd Nazlan Mohd Ghazali. - FMT
