PUTRAJAYA: The Court of Appeal has set April 5 next year to hear M Indira Gandhi’s appeal for leave to commence contempt proceedings against the inspector-general of police (IGP).
Indira’s lawyer, Rajesh Nagarajan, said the hearing date was fixed by a deputy registrar of the appeals court earlier today. Senior federal counsel Mankiranjit Kaur appeared for the IGP.
The appeal was filed after the Ipoh High Court dismissed her application in August last year.
Indira filed the proceedings claiming the police have failed to comply with a mandamus order issued on May 30, 2014 to recover daughter Prasana Diksa from her former husband, Riduan Abdullah.
She also claims the police have failed to file a monthly affidavit annexing copies of their investigation reports.
Riduan, formerly known as K Pathmanathan, took Prasana away in 2009 and unilaterally converted her to Islam.
In 2016, the Federal Court ordered the police to execute a warrant of committal on Riduan for contempt of court over his refusal to return Prasana to Indira, who was given full custody over their three children.
The apex court also remitted the case back to the Ipoh High Court for a judge to monitor compliance.
Besides the bid for committal, Indira had filed a lawsuit against the police and government for alleged inaction in executing a warrant of committal to arrest Riduan for contempt.
The suit is scheduled to be heard in the Kuala Lumpur High Court on Feb 5 next year. - FMT
