'Addicted Hadi doesn't care about social contract, stability'

 


PKR Youth deputy chief Kamil Munim has chided PAS president Abdul Hadi Awang for misusing religion, saying that the latter does not seem to care about Malaysia’s social contract and national stability.

Saying that Hadi (above) appeared to be addicted to issuing harsh statements, Kamil noted that it was wrong of Hadi to react to the recent Federal Court decision to nullify the validity of Kelantan’s 16 syariah criminal provisions by questioning the integrity of the judiciary and the wisdom of Conference of Rulers.

Kamil said Hadi’s latest “time bomb” has exploded and the Marang MP should understand that justice could not be interpreted one way as the parties involved have their conflicts, interests, and desires.

“The court will never be able to satisfy all parties. That’s why we often see, those who previously praised the firmness of the court have criticised the institution today,” he said in a statement.

Earlier this week, the PAS president issued a reminder to all Muslims to safeguard their faith, including judges, lawyers, and politicians.

“What more rulers, to have the vision, to be wise in viewing the hereafter, and not just the interests in this world alone,” he added.

Hadi also said Islam should be prioritised and cautioned that if anything apart from the religion is upheld, “all will not be safe”.

As for the Federal Constitution, the veteran politician said it was crafted by colonisers who plotted independence which hoodwinked the Muslims to never give power to Islam.

PAS’ version of ideal Islam

Kamil said for Hadi, PAS’ version of ideal Islam is the answer to all without taking into account the formation of the country and its demographics.

He added that the party does not care about the social contract and national stability, as its president made a clear violation for the sake of securing power.

“When democracy did not work out in their favour, Hadi branded the Federal Constitution as a trick by colonisers for Malaysia’s independence.

“Ironically, the Constitution did not deceive the Muslims when their comrades were in power,” he said, about PAS’ participation in the regimes of Muhyiddin Yassin and Ismail Sabri Yaakob.

He stated that it was not surprising that Hadi’s sarcastic remark towards the Federal Court’s decision on lawyer Nik Elin Zurina Nik Abdul Rashid and her daughter Tengku Yasmin Nastasha Tengku Abdul Rahman’s challenge had sparked a religious fire.

“He openly disputed the Selangor ruler’s decree by saying that he was simply warning Muslims to defend their faith,” he said.

Kamil said making claims on a purported conflict of interest was nothing more than an attempt to create prejudice against competent judges.

“That is when legal maxims such as ‘justice delayed is justice denied’ was answered with ‘justice hurried is justice buried’,” he said.

Neither static nor simple

He added that regardless of which side one is on, legal matters are neither static nor simple.

“The scales and estimates studied are diverse. Provisions and legal basis should be clear. Evidence and facts must be beyond doubt. Sentiments and (unrelated) things should not be dragged in at all,” he said.

He then questioned if the syariah enactment in Kelantan was more sacred compared to Selangor, based on the Federal Court’s decision in 2021.

“Where were the ‘defend syariah’ screams and howls at that time?”

“The legal question raised (by Nik Elin and Tengku Yasmin) was clear, about state legislation’s jurisdiction in enacting laws as provided under the Federal Constitution.

“The question has been answered clearly and completely. It does not in the least erode the faith and confidence of sane Muslims in the effort to dignify the syariah court institution,” he added. - Mkini
