Nik Elin hopes states will be more careful in drafting laws

 


A Kelantan-based lawyer has expressed hope that today's Federal Court ruling that struck down Kelantan's 16 syariah criminal provisions would lead to states being more careful in drafting laws.

Nik Elin Zurina Nik Abdul Rashid said she was thankful to God for the ruling, which upheld the supremacy of the Federal Constitution and for the betterment of Malaysia.

"It has nothing to do with (challenging) the doctrine of Islam, as the apex court ruled that it was only on the competency of the state legislature.

"I am not doing this (the legal challenge) for myself, I did it for everyone. Alhamdulillah, even after being vilified and lambasted.

"I think after this, state assemblies would be more careful in enacting laws. They would be more careful in drafting laws.

"I hope that this case would harmonise the syariah and civil courts," Nik Elin told the media on the sidelines at the Palace of Justice.

She was accompanied by her daughter Tengku Yasmin Natasha Tengku Abdul Rahman.

Nik Elin also claimed that she never encountered opposition from the Kelantan people over the legal challenge whenever the family returned to their home state.

"Whenever I go back to Kelantan, I receive no vilification. Everybody supported me," she said.

In an 8-1 majority ruling, the Federal Court bench chaired by Chief Justice Tengku Maimun Tuan Mat allowed the constitutional challenge by Nik Elin, 62, and Yasmin, 26.
