PETALING JAYA: The apex court has dismissed an application by businessman Wong Shee Kai, also known as Ricky Wong, for leave to appeal against a ruling ordering him to attend a civil hearing in person.

Wong, the founder of Asia Media, had sought to attend proceedings via remote control technology (RCT), the Securities Commission (SC) said in a statement.

The Federal Court ordered Wong to pay the SC RM20,000 in costs after dismissing his application.

The SC filed a civil suit against Wong, Teh Sew Wan and Wong SK Holdings Sdn Bhd in May 2020 for breaching the Capital Markets and Services Act 2007.

The regulator said the trio were involved in several schemes “to defraud Bright Packaging Industry Bhd in connection with the sale of securities”.

The suit was being heard in the High Court when Wong, who is at large, filed an application in July 2022 for the trial to be conducted via RCT or that he be allowed to attend proceedings or give evidence remotely, if he should decide to testify.

The High Court dismissed his application, saying it failed to satisfy the threshold under the law as he did not disclose his precise location at the time.

It also ruled that the administration of justice would be “brought into disrepute” if Wong were allowed to attend and participate in proceedings remotely since he was “a fugitive”.

Wong’s appeal to the appellate court was also dismissed. - FMT
