Selangor state opposition leader Mohamed Azmin Ali is challenging police summons calling him to give a statement about a speech he made at the Selangor state assembly in March.
At a press conference at Perikatan Nasional’s headquarters in Kuala Lumpur today, Azmin revealed he was summoned under Section 111 of the Criminal Procedure Code on May 7 to have his statement recorded at the Shah Alam district police headquarters tomorrow.
He claimed this was an attempt to intimidate him from performing his duties as an assemblyperson.
It is also a violation of the law, especially Article 72 of the Federal Constitution that grants legal immunity for statements made as part of state legislative assembly proceedings, he said.
“Following this, I have instructed my lawyer to file an application in the Shah Alam High Court for a judicial review of the police’s action and its decision to issue the notice.
“I have also sent a letter to the police to ask them to postpone or suspend summoning me to give a statement regarding the issue as the court proceedings are still ongoing.
“To respect the legal process, they (the police) should suspend any directives as it clearly violates existing provisions,” he told reporters.
However, Azmin said he has yet to receive any feedback from the police on the postponement.
Not showing up for questioning
Asked whether he would still be going for the questioning tomorrow, Azmin replied in the negative.
“The order should be suspended until the court proceedings are over. We should respect our country’s legal processes,” he added.
Previously, Azmin had reportedly asked the Selangor state government during a state assembly debate to explain the Selangor State Development Corporation’s (PKNS) sale of PJ Sentral development rights which is expected to yield a RM1.04 billion return to Malaysian Resources Corporation Bhd (MRCB) for RM270 million.
Azmin also cited a report in The Edge on Feb 29 that property developer Tropicana Corporation Bhd had acquired a leasehold land in Kota Damansara for RM224 million.
However, Selangor Menteri Besar Amirudin Shari, who is also the PKNS chairperson, dismissed allegations that PKNS’s finances are performing poorly and is saddled with an RM5.7 billion debt.
Instead, he said PKNS's current financial position is good and still generating profits from its core operational revenue. - Mkini
