China businessperson files civil suit over alleged robbery

 


A China businessperson has filed a civil suit against PKR member MA Thinagaran, his wife Latha Jothi, the MACC commissioner Azam Baki, the government, and three other individuals for an alleged robbery at his residence in Kuala Lumpur.

In the statement of claim cited by Malaysiakini, Kun Gao, 53, is seeking relief against all defendants jointly and severally for general, aggravated, punitive, exemplary, and other damages. Hisyam Teh Poh Teik will be Kun’s lead counsel.

Kun’s solicitor, Guok Ngek Seong, said the three other individuals are two MACC officers, Muhammad Haffiz Mohd Radzi and Mohd Fahmee Mohamad Nor, and a former officer, Azwan Asli, who were allegedly involved in a robbery at the businessperson’s residence on December 10, 2021.

The writ names seven defendants: Fahmee, Azwan, Haffiz, Thinagaran, Latha, Azam, and the Malaysian government.

Kun alleged that Thinagaran and his wife had passed information regarding his status and wealth to Fahmee, Azwan, and Haffiz.

“The lawsuit was filed on May 14, and some defendants have already been served,” he told the media at a gathering in Bangsar today.

Guok clarified that the amount in damages sought is not quantified as it needed to be accessed by the court first.

Last year in December, Guok questioned why the two alleged masterminds of the 2021 robbery against Kun were still at large despite charges being brought against the two MACC officers and one former personnel over the case.

On December 13 last year, Haffiz, Fahmee, and Azwan pleaded not guilty in two separate Kuala Lumpur Sessions Courts to gang robbery charges in connection with the robbery.

The trio was accused of robbing Kun of RM952,690 and ¥1,225 (RM805) in cash, a silver baggage bag, and a black Louis Vuitton bag.

The gang robbery was allegedly committed at a unit at Ritz Carlton Residence, Jalan Ampang, Kuala Lumpur, around noon on December 10, 2021. - Mkini
