KUALA LUMPUR: A Chinese national has filed a civil suit against the government, three Malaysian Anti-Corruption Commission (MACC) officers, the MACC chief, and a local politician and his wife for allegedly robbing and extorting bribes from him.
According to the statement of claim filed at the Kuala Lumpur High Court on May 14 and sighted by FMT, the plaintiff, Gao Kun, 53, is a Malaysian permanent resident under the Malaysia My Second Home programme.
“Gao is very disappointed with the Malaysian government as no action was taken against the alleged perpetrators until the Kepong MP brought up the issue in Parliament,” Gao’s aide said at a special media briefing here today.
“Although the MACC officers were subsequently brought to court last year after the case was made public, there is still no action against the two others named in his case,” said the aide, who did not wish to be named.
Also present at the briefing were Kepong MP Lim Lip Eng and lawyer Guok Ngek Seong, who is representing Gao.
On Dec 15 last year, both Lim and Guok had called for Putrajaya to take action against a politician and his wife over their alleged involvement in a gang robbery, without disclosing their identities.
Two days earlier to that, FMT reported that two MACC officers and a former MACC officer had pleaded not guilty in the Kuala Lumpur sessions court to charges of gang robbery against Gao.
According to the statement of claim, Gao said the unlawful purported raid by the MACC officers on Dec 10, 2021, at his residence would not have happened without a tip-off by the politician and his wife, who are both close associates of Gao and his family members.
The statement also alleged that the politician’s wife had appeared at Gao’s apartment following the purported raid and actively claimed that she could “settle” the MACC’s investigation into Gao for RM10 million.
The statement also claimed that the politician and his wife had borrowed a sum of RM2.1 million from Gao around Feb 17, 2021 and had yet to return the amount. It also claimed that the duo had repeatedly requested to borrow RM10 million from Gao, which he had refused.
It also said the government, as the employer of the MACC chief and the officials, was “vicariously liable” for all their actions.
Gao is seeking general damages to be assessed by the court, aggravated damages, punitive damages, exemplary damages, costs and further reliefs that the court deems fit and proper.
During today’s briefing, Guok urged the government to take criminal acts against foreigners seriously as this would tarnish the country’s reputation and deter foreign investment.
“Such cases don’t look good (for Malaysia). Investments will flow to countries that have a squeaky-clean record,” he said.
“The government has to actively show it is committed to eradicating extortion.” - FMT
