Tajuddin settles cost payment to Khalid, says delay due to feeling 'hurt'

 


Despite accepting a Court of Appeal decision ordering legal cost payment to Amanah leader Khalid Samad, former Pasir Salak MP Tajuddin Abdul Rahman said he still felt aggrieved by the judge's ruling.

The former Umno supreme council member explained that this was the reason for his delay in settling the RM60,000 amount, after the Kuala Lumpur High Court in October last year dismissed his defamation suit against the former minister with no cost imposed on any party.

"I am willing to pay, I agree with the order of the court (of appeal), the most powerful court.

"I will still pay, but I feel slightly hurt by the decision," he told Malaysiakini.

He said his unhappiness stemmed from the fact that while no party was found guilty after the dismissal of his defamation suit, only one was eventually ordered to pay cost.

"I delayed (the payment) because I was not satisfied, no one is to blame, why do I have to pay?

"I can also claim cost, but I still agree with the court's decision," he added.

Tajuddin (above, right), whose Umno membership was suspended last year, said both parties should be free from bearing any costs.

However, he conceded to settle the cost owed to Khalid, with payment made through a cheque handed to Tajuddin’s lawyer Hasnal Rezua Merican today.

Writ of seizure

The payment followed a reported failed attempt yesterday by a bailiff to enter Tajuddin's residence and execute the writ of seizure and sale from Khalid.

Khalid’s lawyer, Wong Guo Jin, said Tajuddin was “stubborn” in making the payment even though an official demand was made on Oct 19 last year, Free Malaysia Today reported.

"Khalid (later) obtained a writ of seizure and sale from the Kuala Lumpur High Court on April 16, and tried to execute the writ through a High Court bailiff at Tajuddin's house in Bukit Damansara," Wong added.

According to the report, bailiff Marzuki Mohamad and Khalid's lawyer had arrived at Tajuddin's house at 9.40am yesterday, where they were greeted by Firdaus Mufazal Faiz, who claimed to be Tajuddin's officer.

Firdaus prevented them from entering with the excuse that Tajuddin was not home and that the residence was allegedly owned by Tajuddin's wife.

Judgment debtor’s suit

Hasnal claimed that Khalid had initially filed a judgment debtor's suit against Tajuddin to claim the costs, and an agreement was reached between both parties, pending a court process.

"I think they should have informed us that they want to change the way of execution (to collect costs) by not proceeding with the judgment debtor's suit, but instead want to use the writ of seizure and sale.

"I could have advised Tajuddin and the bailiff to come and we can make a payment, not a large amount, only RM60,000," Tajuddin’s lawyer said.

Hasnal added that Khalid's actions to order a bailiff to execute the writ had affected Tajuddin's reputation. - Mkini
