Women, Family and Community Development Minister Rohani Abdul Karim disagrees with inspector-general of police Khalid Abu Bakar's idea of placing children snared in custody dispute caused by religious conversions in childcare centres.
"The case is back at the courts, the inspector-general of police has nothing to do with it," she told a press conference in Kuala Lumpur this afternoon.
Rohani (left) was responding to Khalid who has refused to comply with the Ipoh High Court's and Seremban High Court 's decisions which separately granted custody to two Hindu mothers whose children are being held by their Muslim convert ex-husbands.
Instead, Khalid said he will place the children in a childcare centre until the tussle is resolved.
The fight was sparked by the Muslim fathers winning custody of the children in the Syariah court after secretly converting their children to Islam while the Civil courts granted custody to the mothers.
By convention, the Syariah court will grant Muslim children to a Muslim parent but in the two particular cases, prior to the conversions, the spouses married according to civil law thus the issue landed in the civil courts.
However, Rohani stopped short of asking Khalid to act on the
court orders, and insteadechoed Prime Minister Najib Abdul Razak's (right) statement that the Federal Court will resolve the issue.
She expressed hope that all parties will respect whatever decision the Federal Court arrives at.
The Court of Appeal last month dismissed Muslim convert N Viran @ Izwan Abdullah's application to set aside the Seremban High Court decision granting ex-wife S Deepa custody of their two children.
'Status quo for now'
Izwan has their six-year-old son under his control after forcibly grabbing the child upon losing custody while Deepa still has her daughter.
Elaborating on the case, Rohani said for now, the children will remain with their respective parent.
"The children, one is with the mother, the other is with the father, so let them remain until the Federal Court decides," she said.
She reiterated that putting the children in a childcare centre will only be the very last resort.
Instead, Rohani said if necessary, her ministry is prepared to give counselling to both the children and their parents.
In a separate case, the Ipoh High Court in 2010 had ruled that M Indira Gandhi be granted custody of her child instead of ex-husband K Pathmanathan @ Mohd Ridzuan Abdullah.
The same court on May 30 found Mohd Ridzuan in contempt of court and gave him a week to return the couple's daughter to the mother, failing which it said police must issue an arrest warrant.
It also ruled its decision was above that of the Syariah court's.
Mohd Ridzuan defied the order and police refused to act, prompting the court to issue a rare order against the police on Thursday, instructing that they retrieve the daughter from Mohd Ridzuan, failing which police must explain to the court in an affidavit.
